On the 30th June 2011, and after consultation, the Council of Ministers accepted the recommendation contained within that report and the application was approved subject to compliance with the conditions specified below.

I have the honour to report that on the 23rd May 2011 I inspected the site of the proposed development. The application is being dealt with under the written representations procedure. This report contains a site description, a summary of statements and representations received in connection with the application and my assessment and recommendation.
Site Description \& The Application
The application site is the working area of Stoney Mountain Quarry situated to the east of the A3 Foxdale Road and south of Stoney Mountain Road. Access is via the A24 (Foxdale to Douglas) and B36 (Tosaby Road).
The quarry is in a secluded location surrounded by Stoney Mountain Plantation. Views from the quarry indicate that it may be seen from distant dwellings to the north-east and east.
The quarry is an orderly operation with neat piles of quarried material and restoration, using waste materials from within the quarry operation, on the southern side.
The site lies within an area designated on the 1982 Development Plan as an Area for Surface Mineral Working. In the draft Southern Area Plan shows the site is within an area of Upland Landscape Character within a smaller area of Woodland/Registered Trees. The quarry is annotated as "Stoney Mountain" but not designated for any particular use or form of development.
Quarrying has been in progress on the site for many years. Extensions have been approved from time to time. Planning approval was granted on 10 May 2004 for continued operation of the quarry for a further five years. Planning approval was granted for extensions of time in 2008 and 2010. In 2009 an extension to the working area was approved.
This application seeks to regularise the working of the quarry for a further 12 months from the last approval in 2010.
There is an outstanding planning application (PA 09/1544) for the further extension of the quarry to be presented to the Council of Ministers at a future meeting.
Consultations
Malew Parish Commissioners had no objection.

The approved full extent of the quarry has not been exhausted. This application is sought to be able to quarry the site beyond the latest approved date which expired in May 2011. The same planning conditions as were previously approved should continue with the modification of planning condition 2 on the decision of 03/1867.
There are no objections to application and it is considered the continued working of the quarry for a further year would not have any adverse impact on those living and working in the vicinity of the site.
Assessment
As a result of my site visit and consideration of the evidence submitted, I consider that no harm would arise from the continuation of quarry operations for a further year.
I judge that the planning condition suggested by Planning and Building Control is sufficient.
Recommendation
I recommend that planning approval be granted subject to the condition set out in the attached Schedule.
