In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby APPROVE the application made by you
Proposal: a: Creation of landfill site for inert material Fields To The South Of Stoney Mountain Road Fairy Douglas
which was considered on 19 October 2001, subject to the compliance with the conditions or modifications specified on the attached schedule.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.
Note 2: No works may be commenced until such time as -
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
Note 3: Rights of the appeal against the decision of the planning committee are attached.
Note 4: An appeal must be requested within a period of 21 days.

- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- No works may commence on site until such time as a scheme for the disposal of surface water run-off from the site has been submitted to and approved by the Planning Authority following consultation with the Department of Transport Drainage Division. Such a scheme to be completed prior to the commencement of the landfill operation.
- This approval relates to the tipping of inert material only and for the avoidance of doubt, no approval is granted for the tipping of scrap vehicles, domestic refuse, scrap domestic appliances or demolition rubble.
- This approval relates to the plans and study submitted and date stamped 24th January 2001 and 28th June 2001.
- No work may commence on site until the access to the site from the adopted highway, including visibility splays has been set out and established to the satisfaction of the Planning Authority following consultation with the Highway Authority. The sight lines to the access must be provided in accordance with the Department of Transports standards.
- Vehicles containing materials to provide infill may only visit the site between 0800 and 1730 hours Monday to Friday and 0800 and 1300 hours Saturday. No vehicles containing materials may visit the site on any Sunday or Bank/Public Holiday.
- Prior to the commencement of the landfill operation, the earth bund and fencing to the mirc habitat must be completed on site.
- No development may commence on site until there has been submitted to and approved by the Planning Authority, a scheme for the translocation of orchids from the site.
NOTE: It is recommended that this should form the subject of further consultation with the Wildlife and Conservation Officer of the Department of Agriculture, Fisheries and Forestry.
- When all of the permitted tipping has taken place or by the 1st December 2005, whichever is the sooner, the tipped material must be graded, top-soiled and seeded.
- The levels of the completed landfill area, may not exceed those indicated on drawing number 2170/002 Rev A.
