Officer’s Report
THE SITE 1.1 The site is the residential curtilage of an existing two storey, detached dwelling situated on the outer edge of Abbotts Way within the relatively new housing estate situated between Clagh Vane and Crossag Road. The estate comprises houses of a similar design and finish which is the case in this streetscene, with some properties having been extended - such as number 25 to the south west which has a rear solid-walled extension on the right hand side of the rear elevation extending out from the side elevation closest to the application property.
1.2 The application dwelling has a centrally positioned single storey solid-walled annex alongside which to the left is a conservatory which takes the rear projections up to the line of the side gable. This conservatory is 4m by 2.5m and is 2.4m to the eaves and 3.2 to the apex.
THE PROPOSAL 2.1 Proposed is the replacement of the conservatory with a sun room. This will have a slightly higher (200mm) apex and the same footprint as the conservatory to be replaced but will have brick walling and a tiled roof both to match the finishes on the main house. The roof will have two rooflights within it.
PLANNING POLICY AND STATUS 3.1 The site lies within an area designated on Area Plan for the South adopted in 2013 as Predominantly Residential use. As such, there is a presumption in favour of alterations and extensions provided that they comply with the general standards of development, as set out as follows:
General Policy 2 states: "Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality."

PLANNING HISTORY 4.1 The site has been the subject of a number of applications, since being approved for the erection of a dwelling in the late 1990s, none of which is relevant to the consideration of the current proposal.
REPRESENTATIONS 5.1 Department of Infrastructure Highway Services indicate that there are no highway implications (19.10.15).
5.2 Malew Parish Commissioners indicate that they do not oppose the application (06.11.15).
ASSESSMENT 6.1 The proposed sun room is not significantly larger or higher than the conservatory which is to be replaced and as such will not have any noticeable impact on the appearance of the property or its impact on the living conditions of those in the nearby dwelling (number 25). Whilst there will be windows in the side elevation facing number 25, the conservatory already has a glazed side and as such there will not be any significant change in this impact.
6.2 The proposed extension will sit comfortably next to the existing rear annex which is finished in similar materials and is recommended for approval.
PARTY STATUS 7.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant’s agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material, in this case Department of Infrastructure Highway Services and (e) The local authority in whose district the land the subject of the application is situated.
With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word ‘Department’ to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.
