Officer’s Report
THE SITE 1.1 The site is the residential curtilage of an existing dwelling, Fir Lea which sits on the western side of Phildraw Road in a plot which is 65m to the north of its junction with Crossag Road. The plot is 22m by 87m and has another property to the rear - Dale Rise which has its access directly onto Crossag Road.
1.2 Fir Lea is a two storey, L-shaped dwelling which has two conservatories side by side on the side elevation which sit below a long flat roofed dormer. There is a further, smaller conservatory within the L-shape, attached to the rear elevation. All are brown uPVC framed with polycarbonate roofing.
THE PROPOSAL 2.1 Proposed is the replacement of one of the larger conservatory's roof from polycarbonate to lightweight brown tiles to match the existing main roofing.
PLANNING POLICY AND STATUS 3.1 The site lies within an area designated on Area Plan for the South adopted in 2013 as Proposed Low Density Housing in Parkland. This policy promotes the development of very low density housing of high quality and generally significant size, sitting within at least one acre of its own landscaped grounds. This property does not comply with that definition. The issue would be in this case whether what is proposed would conflict with what this policy aims to achieve.
PLANNING HISTORY 4.1 The property has been the subject of a number of applications for alterations and extensions, none of which is relevant to the consideration of the application, although they reflect the amount of change to which the property has been subject.
REPRESENTATIONS 5.1 Department of Infrastructure Highway Services indicate that there are no highway implications (19.10.15).
5.2 Malew Parish Commissioners indicate that they do not oppose the application (06.11.15).
ASSESSMENT 6.1 The proposed works are not prominent and in any case have little impact on the character and appearance of the property. As such the application is recommended for approval.

PARTY STATUS 7.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant’s agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material, in this case Department of Infrastructure Highway Services and (e) The local authority in whose district the land the subject of the application is situated.
With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word ‘Department’ to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
This approval relates to drawing JTM-74A-P-01 and the location plan both received on 9th October, 2015.
