Some details of these proposed works have been discussed between DEFA Fisheries and Structural Engineering Services Ltd in pre-planning consultation (correspondence copied below for information).
In order to protect the fish populations that are known to be present in the stream below the culvert and possibly within the lower part of the culvert itself, DEFA Fisheries request the following:
Fisheries will respond further to this application once the requested information has been received and considered. In the meantime please contact Inland Fisheries by email or on 685857 with any further queries or to arrange a site visit.

Currently we are working to seek Manx Utilities approval and prepare tender documents so I am currently unable to provide a programme for construction work.
We take note of the recommended construction period and will be working towards that construction period.
I attach a completed Application for Consent to Remove Material from a Riverbed for your attention.
When a contractor has been appointed they will provide a programme and method statement for your comment and if necessary a further completed application form as the contractor will be carrying out the work not Structural Engineering Services Ltd.

Thank you for the information and plans regarding works to the culvert at Dhoor House. DEFA fisheries officers have visited the site and have confirmed that the culvert discharges to a stream which is known to contain fish, including trout and eels. It is possible that the lower section of the culvert itself also contains fish populations. Works to replace the culvert would need to be restricted to the period from July to September (inclusive) in order to protect eggs and young fry, which are particularly sensitive to disturbance from sediment load outside of this period.
A site visit will also be required prior to any works, so that ways of minimising impact on the stream can be discussed and a method statement agreed. Please find attached a material extraction form that it will be necessary to complete, to provide DEFA, Fisheries with further information. Permission from Manx Utilities will also be required, if this has not already been sought.

Dear Mrs Gledhill,
I spoke today with Karen Galtress in reference to proposed drainage work at Dhoor House. There is an existing section of stone culvert restricting water flow in the drainage ditch. It is proposed to replace the culvert with a correctly sized pipe removing the flood risk to Dhoor House. I have attached a location plan (1305-101) and a General Arrangement drawing (1305-100).
Can you please confirm if any restrictions will need to be placed on the contractor when they are carrying out the proposed work in and around the drainage ditch.

Under Section 18 of the Fisheries Act 2012, consent must be obtained from DEFA prior to removing material from the bed of any river. River in this instance is defined as 'any natural or artificial channel through which water flows and includes a tributary or stream'. Certain activities have greater impact on a watercourse at different times of year (e.g. at times of high water temperature or low flow conditions). Please give details of the timing of phases of the development which are likely to affect the watercourse. Note in-channel works are not normally permitted between the months of October to June inclusive.
These substances are highly damaging to the aquatic environment. Please give details relating to the use of these materials and how you intend to prevent their introduction into the watercourse.
Many common building materials such as paint, solvents, fuels, lubricants etc. may also be hazardous. Please give details relating to their potential use and how you intend to prevent the introduction of these materials into the watercourse.
Although they may be diluted, the washings from cleaning equipment and other works may also contain substances harmful to the aquatic environment. Washings often go unnoticed as the activity may be carried out some distance from the watercourse, however they can flow or percolate into the watercourse causing harm. Please give details as to how such washings are to be managed.
Soil, clay or other similar material may form suspended solids once introduced to the aquatic environment these may have a physical effect on the organisms themselves such as suffocation and may also damage the habitat e.g. the destruction of spawning sites. Please give details as to how the introduction of such material is to be prevented.
It is always wise to have contingency measures in place and be aware of what to do and who to contact in the event of an incident. Often simply seeking advice prior to any activity where an element of uncertainty exists can prevent such incidents. Please give details of what measures will be taken to ensure that the workforce is sufficiently aware of the potential hazards to the watercourse posed by the proximity of the works and what to do in the event of an incident arising.
Where possible please give contact details of the person responsible for ensuring that the above measures are carried out and that the watercourse is protected.

As of 1st May 2013, under section 1(1) of the Fees and Duties Act 1989, the Inland Fisheries (Fees) Order 2013 comes into operation.
This means that any persons conducting works in or near watercourses will be charged as follows for the capture and relocation of fish should this measure be deemed necessary by DEFA Fisheries Officers.

Visits to watercourse owners and tenants for the purpose of providing advice on conservation and enhancement of watercourse habitats will remain free of charge.
Section 32 of the Fisheries Act 2012 allows for the protection of fish and their habitat and any works in or near watercourses have the potential to cause damage e.g. through the disturbance of spawning areas or the creation of sediment which can clog the gills of small fish. A breach of this can result in prosecution and contractors are encouraged to contact the Inland Fisheries team for expert advice and guidance on how best to undertake relevant works with minimal damage to the ecology of the watercourse. Early consultation may minimise the need for fish relocation and the charges incurred should it prove necessary.
Please note that with the exception of routine drainage ditch management, written consent must be obtained from the Isle of Man Water & Sewerage Authority (tel. 695949) prior to conducting any works in or adjacent to any watercourse.
