Tel 01624 685950 Penketh - Millar 23 West Quay Ramsey Isle Of Man IM8 1DL TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr Peter Clucas, Ref 15/00987/B, for the Drainage refurbishment works at Dhoor House Andreas Road Dhoor Ramsey Isle Of Man IM7 4EB subject to compliance with the following condition(s) and notes (if any) : 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. 2. Prior to the commencement of any works a soft landscaping scheme is required to be submitted to and approved in writing by the Planning Authority and these works shall be carried out as approved. Details of the soft landscaping works include planting to the roadside boundary, reinstating the existing hedgerow and should include details of species, heights, and centres. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the operation of the hereby approved Drainage scheme, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species. Reason: To ensure the provision of an appropriate landscape setting to the development. 3. Works shall only take place at the site between the months of July and September inclusive, unless prior to that a suitably qualified ecologist has conducted an inspection of the site and found there would be no impact on any vulnerable eggs and fry within the site and an agreement is made with the Department. Reason: To afford suitable protection to vulnerable eggs and fry. NOTE The applicant is advised that prior to any works commencing on the site they should contact the DEFA - Fisheries Directorate to arrange a site visit so ways of minimising impacts upon the stream can be discussed, and a method statement should then be provided and agreed with the Fisheries Directorate and these works are carried out in

Furthermore, it may be necessary for the Fisheries Directorate to carry out electrofishing within the existing culvert to remove and relocate any fish prior to work beginning. This approval relates to drawings reference numbers 100 REV B, 101 and 102 REV A all received on 27th August 2015. Date of Issue: 10th December 2015 Director of Planning and Building Control Guidance Note This decision was made by the Head of Development Management in accordance with the authority delegated to her in the name of the Minister and/or in the name and on behalf of the Department. This permission refers only to that required under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: · Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2015 (currently £165); · The reasons for making the appeal; and · An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. An appeal form and guidance notes are available from either Planning & Building Control, Tel 685950, or to download from the Department’s website https://www.gov.im/categories/planning-and-building-control/planning- applications/planning-appeals/how-to-appeal/ The proposed development must not be commenced until either; · The time for requesting an appeal has expired; or · Any appeal has been determined; Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
