The Site
The application site is located on Loch Promenade Douglas, Sunken Garden No.1. It is located within the Douglas Promenade Conservation Area Order 2002.
The Proposal
Proposed is the relocation of the David Kewley (Dawsey) memorial to a site within Sunken Garden No.1 Loch Promenade.
Planning History
The following application is considered relevant in the decision of this application. The following application was granted permission:
PA 04/02609/B Refurbishment of sunken gardens; to include disabled access and relocation of memorial.
Development Plan Policies
The application site is classed as "Public Open Space" Douglas Local Plan 1998 and is within a Conservation Area, the Douglas Promenade Conservation Area Order 2002. Environment Policy 35 Isle of Man Strategic Plan (20th June 2007) will be used in assessing the proposal.
Consultations
Department of Transport Highways and Traffic Division have made no comment regarding the proposal.
Douglas Corporation has no objection with regard to the application.
Assessment
The proposal should be assessed with reference to Planning Policy 35 in the Isle of Man Strategic Plan (20th June 2007). This policy states:
"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
Having assessed the application site in conjunction with this policy, the proposal would enhance the site and surroundings. The memorial is currently located in Loch Promenade car park, the Sunken Garden is considered to be a more favourable location for the memorial.
For the above reasons, the proposal is considered acceptable, and should be recommended for approval.
Party Status
The Department of Transport and the Local Authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
