The principle of a replacement dwelling was established by prior approvals on appeal (08/01001/A and 10/00133/REM), as the original Ballachree Cottage was of poor form and appearance without architect…
Housing Policy 14
Requires replacement dwellings not substantially different in siting/size unless improving environment; floor area not >50% greater; traditional design per Circular 3/91; reuse materials or match original. Assessed as compliant: floor area matches original, traditional style better than poor existing, siting improved separation/environment, materials traditional despite no reuse possible post-demolition.
Environment Policy 2
Protects AHLV character unless no harm shown. No conflict per 2010 inspector; officer concurs as site screened, not visible from road, against woodland backdrop, no adverse impact despite siting change.
Environment Policy 1
Protects countryside unless overriding need. Acceptable as replacement dwelling exception under linked policies.
General Policy 3
Presumption against development outside zoned areas except replacements (d). Proposal fits replacement exception and curtilage extension has no adverse amenity/landscape impact, preserving rural character.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Sightlines
The existing sightlines identified on [specify plan number and stamped date of receipt] shall be kept permanently clear of any obstruction exceeding 1050 mm in height above adjoining carriageway level. Reason: In the interests of highway safety.
Permitted development restrictions

Reason: To control development in the interests of the amenities of the surrounding countryside.
Tree protection
No site works or clearance shall be commenced until protective fences which conform with British Standard 5837:2012 (or any British Standard revoking and re-enacting British Standard 5837:2012 with or without modification) have been erected around any existing trees. Unless and until the development has been completed these fences shall not be removed and the protected areas are to be kept clear of any building, plant equipment, material, debris and trenching, with the existing ground levels maintained, and there shall be no entry to those areas except for approved arboricultural or landscape works. Reason: To safeguard the areas to be landscaped and the existing trees and planting to be retained within the site.
