The Site
The site represents the curtilage of an existing terraced cottage situated on the northern side of Shore Road alongside the harbour in Port St. Mary. The property is one of three terraced stone faced cottages which retain much of their original character other than for a row of rooflights throughout the terrace on the front pitch - approximately four per property. The windows in the application property are possibly the original sliding sashes with a six pane pattern on the top and bottom lights. The windows have horns on the underside of the top sash.
Planning Status
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Existing Predominantly Residential and on the draft Southern Area Plan as Residential.
Planning History
Planning permission was sought and granted for the installation of rock anchors and retaining walls at the rear of the property under PA 90/4228 and the erection of a front porch under PA 02/0064.
The Proposal
Proposed now is the replacement of the existing windows with plastic framed sliding sashes with the same glazing pattern.
Representations
Assessment
The property does not lie within a Conservation Area, nor is it Registered and as such there are no special policies guiding development of the property. The site lies within a very mixed area architecture-wise and there are very modern, much older and new buildings all in close proximity of each other. The Department has guidance on the replacement of windows, which is set out in Planning Circular 1/98 which requires that windows in properties which maintain their original character should resemble the originals in opening style which the proposed windows would do. The difference between the existing and the proposed would be the material of the frames and possibly a thickening in the section of the frames, little of which would be discernible to those passing by.
There is no specification regarding the glazing bars and it is advised that the glazing bars appear on the outer face of each pane to replicate the existing glazing pattern.
As such the proposal is considered to be acceptable.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

This permission relates to the replacement of windows as shown and described in the plan reference 61.1.09 received on 17th September, 2009.

It is recommended that the proposed glazing bars are fitted to the outer face of each pane to replicate the existing glazing pattern.
