In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

- Erection of a detached dwelling and garage (comprising amendments to PA 08/01079B)
- Land Adjacent To: Westham, Arbory Road, Castletown, Isle Of Man
which was considered on 10th September 2009, subject to compliance with the conditions specified below.

Schedule Of Conditions:
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This permission relates to the erection of a dwelling as shown in drawings 01, 02, 03, 300, 50 and 51 all received on 23rd July, 2009.
- Prior to the commencement of any works on site, the applicant must protect all existing trees on site which are marked on plan 02 to be retained, for the duration of the development, by means of a stout fence erected beneath the drip line of the trees closest to the proposed dwelling and works associated therewith and thereafter the protected area must remain free from stored material and parked vehicles and no building or excavation works may be carried out within such area.
NOTE In order to limit change and damage to the ecological interest of the site, principally for bats, the applicant/occupant is encouraged to introduce flowers and plants which attract insects and for any lighting to be low level and low intensity.
This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
Guidance Note This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Whichever is the later.
