I refer to the recent appeal in respect of the above planning application.
In accordance with the provisions of the Town and Country Planning (Development Procedure) (No 2) Order 2013, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.
The Minister, the Hon P A Gawne MHK, has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the Planning Authority's Refusal of the application under Article 6 of the Town & Country Planning (Development Procedure) (No 2) Order 2013 should be confirmed. In pursuance of his powers under the above Act and Order, the Minister for Infrastructure, the Hon P A Gawne MHK, does hereby REFUSE planning application 14/00761/8 by Mr William Reubens for Erection of a dwelling with driveway and parking at Alder Oaks, Fields 431505, St Marks Road, St Marks, Bellassila, for the following reason(s):
- The proposal is contrary to the provisions of Strategic Policy 2, Spatial Policy 3, Environment Policy 1 and General Policy 3 of the Isle of Man Strategic Plan 2007 in that the proposed development lies outside of areas that are zoned for development in the recently adopted Area Plan for the South and as such is in fundamental conflict with the policies of the Strategic Plan which seek to protect the countryside for its own sake and to direct development to sustainable locations.
- The proposal is contrary to the provisions of General Policy 3 of the Isle of Man Strategic Plan 2007 in that the proposed development does not fall within any of the listed exceptions to the restrictions on development outside areas zoned for development.
- The proposal is contrary to Strategic Policy 10 as defined by the Isle of Man Strategic Plan 2007, in that the proposal by reason of its relatively remote location for access to services and facilities in settlements would be likely to result in reliance on private motor vehicles and as such would not promote a more integrated transport network.
