The site represents the curtilage of an existing dwelling situated between Tower Road and a slightly higher cul de sac which runs to the north of Gorse Bank, the application site, Brackenbank and Headland Cottage. The property is a large one which has been the subject of a number of applications for alteration and extensions, introducing new areas of terracing and decking. Gorse Bank is a traditional cottage which sits to the north east with a large flat roofed front annex which adjoins the application property. Brackenbank is also a substantial property which sits to the south west and has an extension with windows in, attached to the south eastern elevation.
The site lies within an area designated as Residential on the Port Erin Local Plan of 1990.

This condition was discharged.
Now proposed is the installation of a trellis on the fence between Brackenbank and the application property. The trellis will increase the height of the wall by 1 m up to a height 3.7 m in front of The Arches and from there the fence will step down to within 3 m of the end of the lowest terrace of The Arches. The height of the terracing ranges from 800 mm to 3 m .
Port Erin Commissioners indicate that they do not object to the application. The occupant of Brackenbank raises no objection to the application.
The developments which have been proposed on The Arches site have caused concern for the occupants at Brackenbank who have consistently stated the view in the most recent applications, that the development is unneighbourly and will result in overlooking of their property and inter-visibility between the two dwellings. The Planning Committee has not accepted that the proposals would result in any further significant overlooking. However, if the proposed trellis will result in enhanced amenity for the occupants of Brackenbank, there are no public adverse impacts from the proposal, there is no reason why the trellis should not be permitted.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The occupant of Brackenbank is directly alongside the application site and as such should be afforded party status in this instance.
