In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Gellings Free Range Eggs Ltd Proposal: Approval in principle for the erection of an agricultural worker's dwelling at: Field 614870 Adjacent to Cummal Beg Barroose Lane Baldrine Isle of Man IM4 6AN
which was considered on 16th November 2009, for the reasons set out below.

Reason(S) For Refusal:
- The justification put forward within the planning application is insufficient to offset the general planning presumption against development in the countryside. Therefore, by reason that the application site is not designated for development and is located within a wider area of land designated as being of high landscape value and scenic significance, the proposed development represents unwarranted development that is contrary to land use designation, local planning policy and strategic planning policy. Specifically, the proposed development is contrary to Policy L/RES/PR/1 and Policy L/OSNC/PR/1 of the Laxey and Lonan Area Plan Order 2005 and Strategic Policy 2, Spatial Policy 5, General Policy 3, Environment Policy 1, Environment Policy 2 and Housing Policy 4 of the Isle of Man Strategic Plan 2007.
- The submitted planning application fails to demonstrate that the application site can be accessed in a safe manner that does not cause compromise highway safety.
This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
