Application No.: 09/01109/B Applicant: Mr Phillip Maltby Proposal: - 87/01524/A - Approval in principle to erection of three terraced houses - Approved at appeal (1st January 1994) - 88/01895/B - Erection of 3 town houses - Refused (1st January 1994) - 89/00652/B - Erection of 3 terraced dwellings with associated car parking, land at corner of Victoria Road and Cronk Road, Port St Mary - Approved at appeal (1st January 1994) - 07/01421/B - Erection of a two storey extension on side elevation to provide additional living accommodation. ### Assessment The application site is located within an area of 'Predominantly Residential Use' under the Isle of Man Development Plan 1982. Given the nature of the proposed development it is therefore appropriate to assess the proposal against the policy identified earlier within the report (i.e. General Policy 2 and Paragraph 8.12.1 of Isle of Man Strategic Plan 2007). Having assessed the proposed development against the above it is concluded that the proposal is acceptable by reason of its siting, scale, form and design. The property is not within a Conservation Area and the proposed white UPVC window would match the existing. It is considered that the change from the existing window and door to a double glazed window will not have a detrimental effect on neighbouring dwelling no. 16 Victoria Road. ### Representations No comments have been received. ### Recommendation For these reasons the proposal is considered acceptable and it is recommended that the planning application be permitted. 11 August 2009 09/01109/B PARTY STATUS There have been no comments submitted in relation to the proposed development. Site Address: 18 Victoria Road Port St. Mary Isle Of Man IM9 5AF ### Considerations Case Officer: Ms Henrietta Hopkins Photo Taken: - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption. ### Planning History The property has had previous planning applications submitted which is considered to be relevant to this Recommended Decision: Permitted Date of Recommendation:** 11.08.2009
