PLANNING STATUS AND RELEVANT POLICIES Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2 and Environment Policy 35.
Assessment
The application site is within a Conservation Area. The proposal is to demolish the existing outbuildings in the rear yard and to construct a timber shed.
In respect of a procedural matter, Section 19 of the Town and Country Planning Act 1999 deals with the control of demolition in conservation areas. This imposes a requirement for consent for the demolition of non-registered buildings in conservation areas that is comparable to the control that exists over the demolition of registered buildings. It should be noted that a separate application for Registered Building Consent has not be submitted to the Planning Authority for consideration.
This proposal, in my mind, results in the total demolition of an unlisted building in a Conservation Area and therefore a consent under Section 19 of the Town and Country Planning Act 1999 would be required in this instance.
In respect of the impact of the proposal on the Conservation Area, the proposed works are set to the rear of the property and will not be visible from the public highway of Hildesley Road. The proposal will not adversely affect the visual amenities of the streetscene.
In respect of the impact on No.1 Hildesley Road, the neighbouring property has an outrigger which projects along the boundary of the application site. The proposed shed will have minimal impact to the residential environment of No.1 as the shed only marginally projects about the boundary wall of the neighbouring property.
It is recommended that planning permission be granted subject to conditions in the attached schedule.
