Refusal Notice 09/00354/B
Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
Mr George Fincher Digital Development The Old School East Baldwin IM4 5EP
In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mrs H Reeve Proposal: Erection of a free standing wind turbine at: Dwelling At Ballacashin Farm Abbeylands Isle of Man IM4 5EG
which was considered on 25th June 2009, for the reasons set out below.
Date of Issue: 26th June 2009
Murray House Mount Havelock Douglas
Deputy Secretary to the Planning Committee
Reason(S) For Refusal:
- Whilst the use of renewable sources of energy is generally supported there is a need to balance their acceptability against their impact. In this instance, by reason of its location and prominence within the area the proposed wind turbine will cause unacceptable harm to the visual and general amenity of the area. As such the proposal is contrary to the presumption against development outside of areas zoned for development and the protection of the countryside set out by General Policy 3, Environment Policy 1 and Energy Policy 4 of the Isle of Man Strategic Plan 2007.
This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
