The site represents the curtilage of an existing terraced property situated on the eastern side of Lime Street, backing onto the harbour and part of a terrace of other residential properties of varying heights and widths, some rendered and some stonework. The property in question is a stone fronted property with plastic framed casement windows despite an otherwise traditional appearance. The property is slightly taller than the neighbouring property to the south and the same height as the property to the north which has a large flat roofed dormer on the front pitch.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Residential.
No planning applications have been submitted in respect of this site.
Proposed is the installation of a dormer similar to that already on the front pitch of number 9 alongside. The dormer would be approximately the same height and level as that alongside and with similar rendered cheeks and front.
Port St. Mary Commissioners indicate that they have no objection to the application. ASSESSMENT The property is within a residential area and as such the proposal should be judged against the provisions of General Policy 2 of the Strategic Plan which states: "Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: a) is in accordance with the design brief in the Area Plan where there is such a brief; b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape; d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; e) does not affect adversely public views of the sea; f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; g) does not affect adversely the amenity of local residents or the character of the locality; h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; i) does not have an adverse effect on road safety or traffic flows on the local highways; j)can be provided with all necessary services; k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; I) is not on contaminated land or subject to unreasonable risk of erosion or flooding; m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and n) is designed having due regard to best practice in reducing energy consumption."
The critical issue in this case is the appearance of the dormer and its impact on the streetscene, as set out in paragraph c above.
The dormer on the property alongside was permitted under the provisions of PA 06/0244 although there is no mention of the dormer in the report, as the extension at the rear was the subject of significant controversy between that applicant and the adjacent neighbour. This dormer therefore has permission which was granted relatively recently.
The dormer is to be set back from the top and bottom of the roof and the sides.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
