The application site is the land behind Broadlands, Churchtown, Ramsey, located to on the southern side of the B17 road, and south of the residential property "Tranent \& Broadlands".
The application site is located within an area recognised as being an area of "Woodland" not zoned for development, under the Isle of Man Development Plan Order 1982. The site is not within a Conservation Area, but is within an area zoned as High Landscape Value or Costal Value and Scenic Significance.
As the site is located within an area of "woodland" not zoned for development, within an area of High Landscape Value or Costal Value and Scenic Significance and due to the proposed development, the following policy is relevant:-

Policy 2: The present system of landscape classification of Areas of High Landscape or Coastal Value and Scenic Significance (AHLV's) as shown on the 1982 Development Plan and subsequent Local and Area Plans will be used as a basis for development control until such time as it is superseded by a landscape classification which will introduce different categories of landscape and policies and guidance for control therein. Within these areas the protection of the character of the landscape will be the most important consideration unless it can be shown that:

PROPOSAL The application seeks retrospective approval for the creation of access road, constructed from the recently demolition dwelling nearby, with a approximate length of 70 metres and a width of 5 metres.
Lezayre Parish Commissioners:- "Agreed majority" Highways Division:- "Do not oppose" The Authority has received no privately written representations objecting to the application.
The material used for the creation of the new access was from the recently demolition property nearby, which was subject to a replacement dwelling application under 08/01001/A.
The applicant has stated that there was a track previously which connected the lane to the stable building; however, over time and limited use, it became completely overgrown.
From the nearest public highway 60 metres away, the new access cannot be seen, given the substantial landscaping (mature trees/hedgerows), properties Tranent and Broadlands between blocking any view and given the ground level of the site is significantly higher than the public highway.
The track currently does not look attractive and does not add to the quality of the surrounding landscape. However, it is considered that over time the track will appear less stark when viewed from the application site, especially when grass etc start to grow.
For these reasons it is considered the track does not significant harm the character and quality of the landscape, especially over time and therefore complies with the relevant planning policies of The Isle of Man Strategic Plan (20th June 2007), for the reasons set out in this report, accordingly, it is recommended that the application be approved.

C 1. This approval relates to the creation of access road as proposed in the submitted documents and drawings JNC (L) and JNC (S) all received on 23rd February 2009.
