1.0 THE APPLICATION SITE
1.1 The application site comprises Chestnut Barn within the Slegaby and Ballacottier development in Onchan. It is a mid terrace of 4 dwellings.
2.0 THE PROPOSAL
2.1 The proposal seeks approval installation of a chimney, so that the occupants can have a wood burning stove in the property.
3.0 PLANNING HISTORY
3.1 The application site and surrounding area has been the subject of a number of previous planning applications that could be viewed as material to the assessment of this current planning application. In particular 03/00471/B which granted permission for the development and 06/01195/B which granted permission for alterations to previous approval, including the introduction of dormer windows and chimneys.
4.0 REPRESENTATIONS
4.1 Onchan District Commissioners recommend that the planning application be approved for planning purposes. (30.06.15)
5.0 PLANNING POLICY
5.1 In terms of land use designation, the application site is located within an area of land designated as open space for particular purpose (private woodland or parkland) under the Isle of Man Planning Scheme (Onchan Local Plan) Order 2000 Map No. 2. The application site and surrounding area are annotated as Area 21 for redevelopment for which there are associated policies, however as the site has since been redeveloped they are not considered relevant to the consideration of this application.

5.2 The Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application. The parts of General Policy 2 relevant to this application state: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape, and (g) does not affect adversely the amenity of local residents or the character of the locality".
6.0 ASSESSMENT
6.1 The key issue to consider is the effect the proposed chimney would have on the character and appearance of the dwelling itself and the area in which it sits.
6.2 There are 3 other chimney stacks on this row of houses and the proposal has been designed to match the existing. It is of a modest scale and would not look out of place.
6.3 There is it considered that the proposal is unlikely to have adverse impacts on either of the adjoining properties nor on the wider street scene/area and therefore the proposals are considered to comply with Strategic Plan General Policy 2(b), (c) and (g).
7.0 RECOMMENDATION
7.1 It is recommended that the planning application be approved.
8.0 PARTY STATUS
8.1 In line with Article 6(4) of the Town and Country Planning (Development Procedure)(No2) Order 2013, the following Persons are considered to have sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application: the applicant or, if there is one, the applicant's agent; the owner and occupier of the land the subject of the application; Highway Services and the Local Authority in whose district the land the subject of the application sits.

The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

This approval relates to drawing numbers 15/2471/01, 15/2471/02, 15/2471/03, 15/2471/04 and 15/2471/05 all date stamped as received on 10th June, 2015.
