The replacement conservatory/sun lounge does not increase floor space enough to contravene Housing Policy 15 (extensions not more than 50% of existing) and improves on the existing appearance.
Environment Policy 3
Prohibits development causing unacceptable loss or damage to woodland areas, especially those with amenity or conservation value. Officer assessed the garage near trees; DEFA Forestry confirmed no endangerment with protective fencing under dripline, satisfying the policy as no unacceptable woodland damage.
Environment Policy 1
Protects countryside (land outside settlements or not designated for development) unless overriding national need and no alternative. Site in countryside (woodland/white land); officer found garage and alterations not adversely affecting countryside character, with limited visibility from footpath.
Housing Policy 15
Extensions to traditionally styled countryside properties approved if respecting proportion, form and appearance; only exceptionally over 50% floor space. Sun lounge replacement (18.73m² proposed vs existing) does not exceed limit and improves appearance with timber frame and parallel ridge.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Approved plans
This permission relates to the erection of a garage and conservatory as shown in drawings WL/11/1186/1 and WL/11/1186/2 and the location and site plans all received on 22nd February, 2011.
Tree protection
Prior to the commencement of any construction or excavation works for the proposed garage, protective fencing must be erected under the dripline of the trees to be retained adjacent to the proposed building and this fencing must be retained in situ for the duration of the construction works with no excavation undertaken within the fenced area nor materials stored therein.
Do not oppose; has no adverse traffic management, parking or road safety implications
Do not object
No objection if root protection measures observed; suggests optional removal of poor elm and garage relocation by 3.5m north
Three consultees (Tree Officer, Highways Division, and Malew Parish Commissioners) all responded with no objections to the application, with the Tree Officer suggesting optional tree removal and root protection measures.
Key concern: risk of root and crown damage
Tree Officer
No Objectionif the normal root protection measures etc were observed there should be no problem; May I suggest that if this elm were removed and the proposed garages situated directly in between both the specimen trees located either end, that this would reduce the risk of root and crown damage even further
Conditions requested: normal root protection measures etc were observed
