TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to REFUSE an application by Xanadu Holdings Ltd, Ref 15/00196/B, for the Demolition of existing building and erection of a pair of semi-detached dwellings with parking at Methodist Sunday School Glen Road Laxey Isle Of Man IM4 7AQ for the following reason(s):

• 1. The evidence submitted in respect of the structural stability of Methodist Sunday School is clear that it can be retained, and possibly could therefore be used in redevelopment proposals and thereby protect the existing character of the Area. In view of the important contribution Methodist Sunday School makes to the Glen Road streetscene, and the fact that it is within a Conservation Area, is such as to mean that the application is contrary to General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2007.
• 2. The removal of the front stone boundary wall and the proposed large areas of hardstanding fronting onto the Glen Road would both result in detrimental visual impacts upon the character and quality of the street scene and Conservation Area contrary to General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2007.
• 3. The proposed dwellings in terms of their mass and height would be out of keeping with the street scene and neighbouring properties and therefore contrary to General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2007.
• 4. The proposed submission does not demonstrate that the required visibility splays of 2.4m x 45m can be provided within the applicants own ownership and therefore it is considered the proposal from a highway safety perspective would be unacceptable and have a detrimental safety impact for all road users contrary to General Policy 2 and Transport Policy 4 of the Isle of Man Strategic Plan 2007.

This decision was made by the Head of Development Management in accordance with the authority delegated to her in the name of the Minister and/or in the name and on behalf of the Department.

This decision refers only to that applied for under the The Town and Country Planning (Development Procedure)(No 2) Order 2013.

Whilst a copy of the Officer’s report is included alongside this notice, any wider correspondence which led to the assessment and decision is now available to view on the Government’s website (via Online Services) or at the Department’s offices Murray House, Mount Havelock, Douglas.

Any appeal against this decision must be in accordance with the criteria set down in that instrument.

Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

•  Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150);
•  The reasons for making the appeal; and
•  An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
