The officer assessed the proposal against General Policy 3(f), which permits agricultural development in the countryside as an exception, and found an 'acceptable agricultural need' for the polytunnel…
General Policy 3
GP3 sets exceptions to countryside development restrictions, including for agricultural/horticultural use. The officer tested the 'essential need' for polytunnels to grow chillies (requiring protection) and house poultry, accepting it supports the established farm business and reduces imports/carbon emissions.
Environment Policy 1
ENV1 protects countryside character. Assessed as compliant due to no adverse harm from positioning amid existing buildings and screening.
Environment Policy 2
ENV2 relates to countryside and AHLV. The low-profile polytunnels in setback position with vegetation screening were found not to harm AHLV.
Environment Policy 15
ENV15 concerns visual appearance of agricultural buildings. Lightweight, low-height design read with existing structures deemed acceptable.
Environment Policy 17
ENV17 addresses best location for agricultural/horticultural buildings. Clustering and setbacks limited visual prominence from public views.
Business Policy 1
BP1 supports growth of Island businesses. Polytunnels enable fulfilling chilli demand and farm diversification, aligning with policy.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Removal if agricultural use ceases
If the agricultural use of any of the polytunnels hereby approved ceases for a period exceeding 12 months, that polytunnel and any supporting equipment (including any base) shall be removed and the ground restored to its former condition within 3 months of the date of the cessation, unless a time is otherwise approved in writing by the Department. Reason: The polytunnels have been exceptionally approved solely to meet a specific agricultural need and any subsequent retention would result in an unwarranted intrusion in the countryside.
