This application has been recommended for approval for the following reason. The installation of the non-illuminated and illuminated signage on the site complies with The Control of Advertisements Regulations 2013 and is also in accordance with General Policy 6 of the Isle of Man Strategic Plan 2016.

Officer’s Report
1.0 THE SITE
1.1 This application relates to the curtilage of the Lezayre Parish Community Hal which is located on Clenagh Road just north of its junction with Main Road.
1.2 The building is not Registered and the site is not within a Conservation Area.
2.0 THE PROPOSAL
2.1 This application seeks express consent to install the free standing timber notice boards currently sited at the Old Caley Stores, on the main road through Sulby. There are two freestanding noticeboards each of which have two glass doors. The two noticeboards would be sited immediately next to each other and joined together at the top by a wooden banner.
2.2 It is proposed that the noticeboards will be sited to the side of the Hall immediately in front of the low wall that runs along the edge between the hall and entrance into the car park. The proposed siting has been designed to respect the building line of the front elevation of the Hall.
2.3 The notice boards which would be supported by posts are 0.96m high and with the banner above would attain a maximum height above ground level of 206.5 cm. The width of the noticeboards and posts combined would be 1.7m.
2.4 Both noticeboards are lockable and not illuminated.
3.0 PLANNING HISTORY
3.1 There are no applications considered to be relevant to this application
4.0 PLANNING POLICY
4.1 The site lies within an area defined as Worship on the Sulby Local Plan 1998.
4.2 The Control of Advertisements Regulations 2013 make it clear that the only considerations which can be applied to applications made under them are in the interests of amenity and public safety. In the case of amenity, such things as the general characteristics of the area need to be taken into account along with the presence of any features of historic, architectural, cultural or similar interest and the public safety should consider the safety of any person using a road, railway, tramway, harbour or aerodrome including the obscuration of any traffic sign or similar.
4.3 Further to the above it is relevant to assess the application under General Policy 2 which sets out general development standards, General Policy 6 which sets out what is expected for the display of external advertisements and General policy 7 which sets out that the display of adverts must be in relation to the site they are situated upon.
5.0 REPRESENTATIONS
5.1 The Department of Infrastructure Highways Division - Have no interest in the application (24.11.2023).

6.1 The main issue with regard to this application is the impact that the proposed signage would have on the amenity and public safety of the locality and character of the Hall and street scene.
6.2 The proposed notice boards are to be relocated from their current location which is the private curtilage of the Old Caley Stores, on the main road through Sulby as this building has been bought by a developer who is extending the property. It is considered that this proposed siting would strike a balance between being visible without encroaching on the highway.
6.3 It is considered that the design of the noticeboards is appropriate to its location and would not be detrimental to the character of the Hall or locality.
7.0 CONCLUSION
7.1 It is considered that the size, scale, siting and design of the signs are acceptable and relates to the proposed location. The noticeboards would have no adverse visual or amenity harm to the public or public safety and would provide a community facility. As such the application would accord with The Control of Advertisements Regulations 2013, as well as meeting with the principles of General Policies 6, 7 and 8 of the IOM Strategic Plan 2016. . The application is therefore recommended for approval.
8.0 INTERESTED PERSONS STATUS
8.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) any Government Department that has made written submissions relating to planning considerations with respect to the application (whether pursuant to a notice under regulation 10 or otherwise) that the Department considers material; (c) the local authority in whose district the land the subject of the application is situated; and (d) the Highways, Ports and Railways divisions of the Department of Infrastructure.
8.2 In addition to those above, the Regulation 11(3) requires the Department to decide which persons (if any) who have made written submissions with respect to the application (whether pursuant to a notice under regulation 10 or otherwise), other than those referred to in paragraph (4), should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application. __
I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
