1.0 THE SITE 1.1 The application site is the curtilage of 14 Balleigh Park, Ramsey which is a semi-detached dwelling which is part of the wider residential estate. The property has a driveway to the side and a garage to the rear which is accessed via the driveway. There is an area of grass to the side and rear of the garage. The garden is a level area which has a retaining wall which a fence sits atop, beyond this the land falls away and is at a lower level than the main garden area; approximately 1m from the retaining wall is the boundary fence which is shared with the fields beyond.
2.0 THE PROPOSAL 2.1 The application seeks approval for the installation of decking in the rear garden which would project out to the boundary which is shared with the field. The area of decking would be approximately 29.8sqm. It would be approximately 200mm above the existing grass area. There would be a timber balustrade approximately 1.1m in height on the boundary shared with the field. The decking would be approximately 1.6m above the ground level of the field.
3.0 PLANNING HISTORY 3.1 The previous planning applications are not considered to be specifically material in the assessment of the current application.
4.0 DEVELOPMENT PLAN POLICIES 4.1 The application site is within an area zoned as "Predominantly Residential" identified on the Ramsey Local Plan 1998. Given the nature of the application it is appropriate to consider General Policy 2 of The Isle of Man Strategic Plan (20th June 2007).
5.0 CONSULTATIONS 5.1 Ramsey Town Commissioners indicate that they do not oppose the application (19.02.15).
6.0 ASSESSMENT 6.1 The key considerations in the assessment of the application are the impacts upon the character and appearance of the property and surrounding area and the impact upon the amenities of local residents.
6.2 The proposed decking would be installed over part of the garden and would extend to an area of approximately 29.8sqm. The proposed decking would be only 200mm above the existing garden level and therefore would not result in any undue overlooking or loss of

privacy to the neighbouring properties. It is considered that the proposal would not have an unacceptable impact upon the amenities of the local residents.
6.3 The proposed decking would be visible from the fields which are to the rear of the application site. Given that there is already an existing fence at the same height as the proposed decking and balustrading it is considered that the proposal would not significantly alter the appearance of the property when viewed from the fields at the rear.
6.4 It is considered that the proposal would not have an unacceptable impact upon the appearance of the site when viewed from the main public thoroughfares.
6.5 For the above reasons the application is considered to be acceptable and is recommended for approval.
7.0 PARTY STATUS 7.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; (d) The Highways Division of the Department; and (e) The local authority, Ramsey Town Commissioners in whose district the land the subject of the application is situated.
