Dear Sir/Madam, Application No: 23/00397/LAW Proposal: Certificate of Lawfulness for residential curtilage at Braaid Farm Address: Braaid Farm Top Road Crosby Isle Of Man IM4 4HJ Applicant: Ms Clarissa Beadman
With regard to the above application, I write to advise that the Department has declined your request for a Certificate of Lawfulness under the provisions of section 24 of the Town and Country Planning Act 1999. The following reason(s) have been given:
- Based on the evidence which has been submitted as part of the application, it is considered that on the balance of reasonableness it has not been adequately demonstrated that the use of the area provided within the red line drawing on the provided affidavit as residential curtilage, for a period of time in excess of 10 years. As such it is recommended that the application be refused and a Certificate of Lawful Development not be issued.
