TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to REFUSE an application by BYA LTD, Ref 23/10039/AIR, for the Information in relation to Conditions 06 and 14 of 22/00399/B - Ecological and landscaping details at Ballacroak Farm Mullinaragher Road St Marks Ballasalla Isle Of Man IM9 3AQ.

Any reasons or notes which apply to this decision are set out below.

As the agent has not provided these additional details, a request was sent out on the 13th March 2024 requesting the additional information within 2 weeks or the application would have to be rejected which the agent acknowledged. As this date has passed without the submission of the requested detail it is not considered that the requirements of Condition 6 and 14 has been adequately met.
