THE SITE 1.1 The application site is the curtilage of 18 Sprucewood Rise, Foxdale which is a two storey semi-detached dwelling which is to the south eastern side of the highway. The dwelling is the last property you reach at the end of the cul-de-sac. There is a large conservatory to the rear of the property which is constructed of uPVC with a Polycarbonate roof.
THE PROPOSAL 2.1 The application seeks approval for the installation of a replacement conservatory roof. The replacement roof would be constructed of lightweight roof tiles which would be brown in colour.
PLANNING HISTORY 3.1 The conservatory was approved under PA 05/01033/B which was for a uPVC conservatory.
DEVELOPMENT PLAN POLICIES 4.1The application site is within an area zoned as "Predominantly Residential" identified on The Foxdale Local Plan 1999. Given the nature of the application it is appropriate to consider General Policy 2 of the Isle of Man Strategic Plan (20th June 2007) which states:
"Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality".
CONSULTATIONS 5.1 Patrick Parish Commissioners indicate that they do not oppose the application (03.02.15).
ASSESSMENT 6.1 The key considerations in the assessment of the application are the impacts upon the character and appearance of the property and street scene in general.

6.2 The proposed works are considered to be fairly minor and would have limited impact upon the character and appearance of the property and street scene due to the works being at the rear of the property.
6.3 The proposed roof would be constructed of lightweight tiles which would be finished in the same colour. This proposal is considered to be in keeping with the property and would be an enhancement.
6.4 For the above reasons the application is considered to be acceptable and is recommended for approval.
PARTY STATUS 7.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; (d) The Highways Division of the Department; and (e) The local authority, Patrick Parish Commissioners in whose district the land the subject of the application is situated.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
