UPON consideration of the foregoing matter and having noted the consent of Counsel for the Claimant, the Defendant and the Interested Party and in consideration of an undertaking by the Claimant not to oppose the Interested Party’s imminent new planning application IT IS - by consent of the parties - ORDERED that:-
- the hearing listed for 10:10am on Thursday 21st April 2016 be vacated;
- the decision of the Department of Environment Food and Agriculture (the “Department”) relating to planning application 14/01411/B and dated 3rd September 2015 is quashed and such planning application be remitted back to the Department for re-consideration and/or re-determination as may be required on the basis of the extant report of the Inspector, Mr Amos;
- the Defendant shall pay to the Claimant the Claimant’s costs of and incidental to the proceedings up to the 2nd December 2015 (date of service of Acknowledgement of Service indicating no intention on the part of the Defendant to contest proceedings) subject to detailed assessment on the standard basis in default of agreement;
- There be no order as to costs against the Interested Party.
