s Si!«i Isle of Man Government Kti rrrt CK«ir JTM Architecture 9 Ard Reayrt Ramsey Road Laxey Isle Of Man IM4 7PZ TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2} Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to REFUSE an appiication by MOP Hoidings Ltd, Ref 14/01099/B, for the Alterations and erection of a two storey roof extension to office building at Exchange House 54 - 62 Athol Street Douglas Isle Of Man IMl 13D for the following reason(s): By virtue of its mass and height relative to the otherwise almost uniform height of the terrace within which it sits, the proposed extension fails to preserve the character and appearance of the Conservation Area contrary to Environment Policy 35 of the Isle of Man Strategic Plan 2007. 1. The proposed extension feils to respect or reflect upon the architectural style of Exchange House. As such, the extension would adversely affect the character of Exchange House itself as well as, by consequence, the surrounding townscape. The application is therefore contrary to the provisions of parts 'b', 'c' and 'g' of General Policy 2, Business Policy 8 and Strategic Policy 5 of the Isle of Man Strategic Plan 2007. 2. ITie proposal would result in the need for an additional 18 parking spaces according to the standards in the Isle of Man Strategic Plan. While the application proposed cycle parking facilities, the proposal would give rise to car parking demand that could not be met within the site, leading to greater competition for a shortage of spaces within the vicinity contrary to Transport Policy 7 and part 'h' of General Policy 2 of the Isle of Man Strategic Plan 2007. 3. Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department. This decision refers only to that applied for under the The Town and Country Planning (Development Procedure}(No 2) Order 2013. Whilst a copy of the Officer's report which led to the decision is enclosed, all other correspondence relative to the application is available for inspection at the Department. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1} of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
