Isle of Man Government RrlHw. ff/jn V'jrjjip Marshall Cryer Architects Old School House Cronkbourne Braddan Town and Country Planning Act 1999 The Town and Country Planning (Development Procedure) (No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to REFUSE a planning appiication by Lady Helen Chrichton- Stuart, Ref 14/00847/A, for the application for approval in principle for residential development at Plot Of Land At Karnes Court To East Of Hollin Lane Cronkbourne Douglas Isle Of Man for the following reason(s): Whilst not designated as such, the proposed development would result in the introduction of built development within an area of woodland. The intrusion of development would have a harmful impact upon the open character of the area which would be contrary to General Policy 2 part c), part f) and part g) of the Isle of Man Strategic Plan. 1. It has not been adequately demonstrated that the trees shown as being retained could be successfully protected during or after the development and as such the proposed development is likely to result in an unacceptable loss of or damage to the woodland which would be contrary to Environment Policy 3 of the Isle of Man Strategic Plan. 2. Date of Issue: 13th January 2015 M. Director of Planning and Building Control Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department. A copy of the Officer's report which led to the decision is enclosed. Any appeal against this decision must be in accordance with Article 8 of the Order. A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice.

To further validate the appeal it must contain: • Payment of a planning appeai fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
