We write in response
to your letter dated
23rd May 2014, copy attached
for ease of
reference.
We have been looking
for over 2 years for suitable
premises
on the Island in which
to invest
and develop
our business. We are disappointed
by the continuing
delays and the constraints
that are becoming
evident
in the Isle of Man Planning
system compared
to the UK. That said
the building
is rapidly
nearing
completion
and we are keen to remove
any further
delays.
We
maintain
that
our
proposed
use falls
within
'light
Industrial
Class 5' based
on
our
occupation
of buildings
approved
for
B1, B2 and B8 use in the
UK (please
refer
to
the
attached
GVA table
of General
Use Classes Order). The closest
Isle of Man
use class to B1
and 62 is 'light
Industrial'.
It Is also worth
restating
that permitted
change of use between
these three
use classes (B1 to 88, B2 to 81 or 88 and B8 to 81) is allowed
in the UK, which
illustrates
the general
acceptance
that
Impact
of these three
uses Is very similar
In planning
terms.
There
Is no additional
level
of harm
created.
Equally
It is worth
re stating
that
we
already
operate
from
a light industrial
development
on the island.
However,
we are keen to secure
our Investment
In the
Isle of Man and will agree,
for the
avoidance
of argument
and
further
time
wasting,
to
accept
your
description
of
our
proposed
use Is sui gener/s.
We note that in your letter
of 23rd May 2014 you helpfully
reaffirm
that;
'1/ the bulldlng was substantial
complete, which It Is not, the planning application
could have been for a planning approval for alterotlons and change of use of the
building',
The developer
has confirmed
that
work
on Block A was not stopped
and consequently
the
building
will
be substantially
completed
in approximately
2 weeks
from
the
date
of this

letter, (including the completion of workS that we do not require, but had to undertake to
reach completion), We have therefore
updated and attached
5 copies of the application
form and would ask that you progress the application.
We understand
that you feel the sale of domestic appliances to our trade customers Is an
important consideration in determining this application. We will accept a planning condition
stating that "No domestic appliances will be sold from these premises".
Ultimately similar uses to that being proposed can be found on all light Industrial estates
around the Island and the UK. The Strategic Plan Policy 5(a) & (b) provides for a trade
counter and there is an overwhelming precedent for our proposed use and we should have
a reasonable expectation that if we can operate on other light Industrial estates. then why
not on this one? The Eden Park site offers a quality of development
that we have been
unable to find elsewhere on the island, Eden Park is the only development that offers us a
quality product in close to Douglas. A quality building is important to us and will help us
grow our business more effectively than older, poorly maintained or dilapidated premises.
We look forward to your confirmation that all is In order and no additional application fee Is
required and that this application can proceed to decision without delay.
