Isle of Man Co\vmn)cnl Eden Park Developments Ltd Ballapaddog Cooil Road Braddan IM4 2AF TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE an application by Yess Electrical Ltd, Ref 14/00443/B, for the Conversion of existing building for light industrial to assembly of electrical components/showroom/trade counter/storage/distribution and ancillary offices (Sui Generis) for Units A1-A4 and light industrial (Use Class 5) for Units A5-A6 at Units A1 To A6 Block A Ballapaddag Industrial Estate Douglas Isle Of Man subject to compliance with the following condition(s): The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. 1. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals, The net floorspace area for the showroom/trade counter must not exceed 112 square metres and must be devoted to the sale of electrical goods in connection with the construction industry, and not domestic appliances or domestic goods (unless agreed otherwise in writing by the Department) and for no other purpose (including any other purpose within Class 1 of Schedule 4 to the Town and Country Planning (Permitted Development) Order 2012 or in any provision equivalent to that Class in any statutory document revoking and re-enacting that Order with or without modification.) 2. Reason: To protect the vitality and viability of the existing town and village centres. Units A5-A6 hereby permitted must be used for light industrial purposes only (Class 5 of Schedule 4 of the Town and Country Planning (Permitted Development) Order 2012 or in any provision equivalent to that Class in any statutory document revoking and re enacting that Order with or without modification,) 3, Reason: To protect the long term use of the units for light industrial purposes only. The development hereby approved shall not be occupied or operated until the parking and turning areas have been provided in accordance with the approved plans. Such areas shall not be used for any purpose other than the parking and turning of vehicles associated with the development and shall remain free of obstruction for such use at all times. 4. This permission refers only to that required under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
