Officer's Report
The Site
The application site is the curtilage of The New Manila Café/Restaurant, Marathon Terrace, Queens Promenade, Douglas. The property is situated to the north west of the promenade, and adjoins Mona Cottage and 1a Marathon Terrace. The property is currently vacant.
The Proposal
The application seeks approval for alterations to the front elevation including alterations to the doors and the installation of an awning.
Planning History
The previous planning applications are not considered specifically material in the assessment of the current application.
Development Plan Policies
The application site is within an area zoned as "Tourism/Residential" identified on the Douglas Local Plan 1998. It is also within the Douglas Promenades Conservation Area. It is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).
Consultations
Douglas Corporation has no objections.
Highways Division do not oppose as it has no adverse traffic management, parking or road safety implications.
Assessment
Given the nature of the application it is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan, which states:
"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
The application seeks approval for the alterations to the front elevation, including the installation of a doorway, the erection of an awning and the construction of two new concrete steps.
The proposed doors would be constructed of hardwood, the existing tiles would be removed of the front elevation and it would be finished with smooth render and would be painted.
It is considered that the proposed development would not have a harmful impact on the character and appearance of the property or the Conservation Area in general. The alterations would enhance the appearance of the property by using hardwood doors and retaining some of the detailed windows in the front elevation.
It is judged that the proposed awning would not be detrimental to the character and appearance of the property or the Conservation Area in general.
For the above reasons the application is considered to be acceptable and is recommended for approval.
Party Status
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the door alterations and installation of an awning as shown in drawings 1709 02 P01 and Lamp Details received 11th February 2011.
