Erection Of Fencing (Retrospective)

- Retrospective Planning Application 17/01212/B was been refused for the following reasons:
1) The proposed fence by reason of its height, position, design and material finish does not respect the site and its surroundings and brings about an unwarranted intrusion to the visual quality and character of the street scene and as such fails to comply with parts (b), (c) and (g) of General Policy 2 and
2) The proposed fence by reason of its height, position, design and material finish adversely impacts the character and views into and out of the adjacent Peel Conservation Area failing to meet Environmental Policy 36.
- In consideration of the above, the new Planning Application (retrospective) proposes to retain some sections of the erected height fencing and to reduce the height of the fencing along Glenfaba Road and returning into Creggans Avenue from 1.80m high to 1.20m high tapering up/down at height changes, with the proposal to stain the fence timbers green so that the entire erected fencing will:
1) by reason of its height, position, design and material finish, respect the site and its surroundings and not bring about an unwarranted intrusion to the visual quality and character of the street scene and not fail to comply with parts (b), (c) and (g) of General Policy 2 and:
2) by reason of its height, position, design and material finish not adversely impact on the character and views into and out of the adjacent Peel Conservation Area so as not to fail to meet Environmental Policy 36.
- The submitted plan indicates the timber close boarded 'lollipop top' fence heights in this further application:
- 'A' to 'A'1 to remain in height as erected - 1.50m
- 'A'1 to 'A'2 to remain in height as erected - tapering 1.50m up to 1.80m
- 'A'2 to 'B' to remain in height as erected - 1.80m
- 'B' to 'B'1 to taper down from 1.80m to 1.20m
- 'B'1 to 'B'2 to be 1.20m high
- 'B'2 to 'C' to taper up 1.20m up to 1.80m
- 'C' to 'D' to remain in height as erected - 1.80m

- At all times the reason for erecting the perimeter fence is to create a secure family home and garden to replace the unsightly hedging, garden (with shipping container), general unkempt mess as the previous owner had.
- The corner plot location of the property is extremely windy, on a relatively busy main access road into and out of Peel and a perimeter fence makes secure use of the garden by finishing off and improving the external areas of the site.
- With the removal of the old hedging, new evergreen Griselina hedging has been planted between the rear of the existing boundary wall which will, when fully established hide the fencing from view.
- There were no objections made to the previous retrospective Planning Application 17/01212/B by any of the occupiers of the properties opposite on Glenfaba Road.
- There was no opposition made by the Dol - Highways Division to the previous retrospective Planning Application 17/01212/B
Observations:
- The mixture of existing hedging, timber lollipop fencing and decorative concrete block walling along the rear of the properties to Cronk Reayrt along Glenfaba Road, most of which are as high and are all closer to the roadway than the proposed fence, by reason of their height, position, design and material finish do not respect the area and surroundings and brings about an unwarranted intrusion to the visual quality and character of the street scene and as such all fail to comply with parts (b), (c) and (g) of General Policy 2 and further all adversely impact on the character and views into and out of the adjacent Peel Conservation Area by failing to meet Environmental Policy 36.
- All of the above equally, if not more so, are visually intrusive on the main entry route to Peel being immediately opposite to the Glenfaba Road commencement of the Peel Conservation Area.
