1.1 The Applicant, Mr Richard Plant, is the owner of the farm at Bay View, Ballamodha, Malew, (the Application Site) where he raises beef cows. He is seeking planning permission to erect two new agricultural buildings on the Application Site, in order to accommodate his herd. One of the proposed new buildings is to replace containers previously erected adjacent to Foxdale Road in the field, to the north of the farm house, which were the subject of planning enquiry JS/13/00047/COMP.
2.1 The Application Site is west of and adjacent to Foxdale Road, just south of South Barrule Plantation.
2.2 The Site is in two parts, separated by a shared lane leading from Foxdale Road to a pig farm. The part to the north of the lane is referred to as Field 1 in this statement. The existing containers are currently located in Field 1. The part to the south of the lane comprises a farmhouse and stable block and is referred to as Field 2 in this statement. Both parts are owned by the Applicant and are part of the same holding.
2.3 Vehicular access to the site is via the lane to Field 1 and via a private separate driveway to the southern part of the site.
3.1 The following previous Planning Applications have been made in respect of the Application Site:

4.1 It is proposed to erect a new cow shed on Field 1, approximately 40m from Foxdale Road and roughly in line with the easternmost large barn of the pig farm.
4.2 It is also proposed to erect a new cow shed on Field 2, approximately 4m from the site boundary, to the south of, and roughly in line with, the large central barn of the pig farm.
4.3 The new buildings will each be approximately 9m wide x 18.3m long x 4.6m high at the eaves. The sheds are to comprise a steel structural frame clad in natural Yorkshire boarding and with roof coverings of natural fibre cement sheeting.
5.1 The relevant planning policy documents pertaining to this application are the Isle of Man Strategic Plan 2007 and the Area Plan for the South 2012. It is not considered that any of the proposals of the Area Plan pertain directly to the Application Site. The relevant planning policies in the Strategic Plan are General Policy 3 (f) and Environment Policy 15.
5.2 General Policy 3 (f): Although the application site is not zoned for development, the proposed buildings are considered to be essential for the conduct of agriculture, as explained in the Applicant’s supporting letter (see Appendix A). It is therefore considered that the proposed development is in accordance with the policy.
5.3 Environment Policy 15:
Field 1: The proposed building is located as far back as possible from the public highway. It would not be desirable to locate the building any further back, as the required access track would take up valuable grazing land. The building is also located as close as possible to the pig farm and oriented at the same angle as the existing buildings, and will visually form part of the farm building complex. Although visible intermittently and at a distance from Foxdale Road, it will be largely obscured by the hedgerows and trees adjacent to the road (see Photographs 01-04 in Appendix B).
Field 2: The proposed building is located as close as possible to the pig farm and oriented at the same angle as the existing buildings, and will visually form part of the farm building complex. The building will not be visible from Foxdale Road, as it will be obscured by the hedgerows and trees adjacent to the road (see Photographs 01-05 in Appendix B).
5.4 The proposed new buildings are on a small scale compared to those of the pig farm, being of approximately 164m2, while the pig farm buildings range in area from approximately 250-900m2. The proposed Yorkshire boarding is considered to be a suitably attractive cladding material and appropriate in the context of the existing buildings.
5.5 The proposed buildings are not situated near any existing residential property, other than the existing farm house, and will be accessed via the existing lane and driveway, which are currently used to access the Site.
5.6 It is therefore considered that the proposed development is appropriate in terms of scale, materials, colour, siting and form, and will be sympathetic to the landscape and built environment of which it will form a part, and therefore complies with the provisions of Environment Policy 15.
6.1 It is considered that the proposed development is essential to the Applicant’s farming activity, and complies with the relevant Policies of the Strategic Plan 2007.
