THE APPLICATION IS BEFORE THE PLANNING COMMITTEE FOR DETERMINATION AT THE REQUEST OF THE DEVELOPMENT CONTROL MANAGER.
1.1 The application site is the curtilage of The Courtyard/House and Home Building, Tynwald Mills, St Johns. The application site is a small area which is part of a larger shopping complex which is a collection of outlet shops.
2.1 The application seeks approval for the erection of glazing to the front of the courtyard shops to provide additional floor area in the form of a covered link from the House and Home Building to the adjacent retail units. The enclosed link would create a large open space which would form part of the House and Home retail unit. The central piers of the arcade would be removed and large glazed panels would be installed. Underneath the central gable would be double glazed doors which would open outwards. The lean-to roof which is above the entrance to the House and Home building would be extended over the new glass infill. 2.2 Also proposed is the erection of a cavity wall off the side elevation of the House and Home Building and would adjoin the side elevation of the arcade units. 2.3 An area to the front of the arcade units would be brick paved to match the other paved areas.
3.1 There have been a number of previous applications for the Tynwald Mills complex, none of which are considered to be specifically material in the assessment of this application.
4.1 The application site is within an area zoned as "Retail" identified on the St Johns Local Plan 1999. It is also within the "Proposed Conservation Area". Given the nature of the application it is appropriate to consider General Policy 2, Business Policy 9 and Business Policy 10 of the Isle of Man Strategic Plan (20th June 2007). It is also appropriate to
consider Policy C/P/1, Policy C/P/2 and Policy C/P/3 of the St Johns Local Plan Written Statement.
Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: a) Is in accordance with the design brief in the Area Plan where there is such a brief; b) Respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) Does not affect adversely the character of the surrounding landscape or townscape; g) Does not affect adversely the amenity of local residents or the character of the locality.
The Department will support new retail provision in existing retail areas at a scale appropriate to the existing area and which will not have an adverse effect on adjacent retail areas. Major retail development proposals will require to be supported by a Retail Impact Assessment { }^{1}.
Retail development will be permitted only in established town and village centres, with the exceptions of neighbourhood shops in large residential areas and those instances identified in Business Policy 5.
In accordance with the Adopted Policy of Tynwald, no retail developments will be permitted in St John's with the exception of retail provision which is appropriate both in terms of scale and character, to the environment of the village. Where practicable, new retail uses should be based upon existing buildings in order to encourage their refurbishment. This policy is in keeping with Planning Policy W/R/P1 as defined in Paragraph 2.3 of the western sector plan (D) 1991. Where possible, off street parking should be provided to cater for staff, visitors and delivery vehicles.
In order to improve the existing facilities in St John's and in particular the Tynwald Hill Area, improvements to existing retail and restaurant buildings will be encouraged. Where facilities are to be extended, some provision for parking should be provided.
Apart from minor alterations to and renovations of existing buildings to tourist/craft uses, no further buildings shall be permitted at the Tynwald Mills Centre.
5.1 No comments received.
6.1 The application seeks approval for the erection of glazing to create a covered link between the existing House and Home Building and the arcade of shops which surround the courtyard. The main issues to consider in the assessment of the application are the principle of the extension, the visual impact of the proposal and the impact on the amenities of the occupiers of the neighbouring properties. 6.2 The proposed glazing would provide a covered area which would increase the retail floor area. Business Policy 10 notes that development will be permitted only in established town and village centres. Tynwald Mills whilst not in the heart of the village centre has over time become an established retail facility. Tynwald Mills is zoned as retail on the
Local Plan and therefore the proposed extension would be in accordance with the land use zoning. 6.3 Business Policy 9 considers the proposed retail development in terms of the scale and whether the scale is appropriate to the existing area. The proposed development would enclose an existing walkway therefore utilising the existing built fabric, it is considered that the installation of glazing would be fairly modest and would be an appropriate addition in terms of scale. 6.4 Policy C/P/3 is considered specifically material in the assessment of this application. In terms of this policy it is appropriate to consider whether the proposed development is judged to be minor alterations as it indicates that no further buildings shall be permitted. In this instance it is considered that the enclosure of an existing walkway could be considered as a minor alteration and not the erection of a building. 6.5 The proposed development is considered to enhance the existing retail facilities and therefore complies with both Policy C/P/1 and Policy C/P/2. 6.6 The proposed alterations and glazing are considered to be a positive addition in terms of the visual impact. To one side of the courtyard is the Neb Cafe which has glazing all along the elevation which faces on to the courtyard. It is therefore judged that the proposal would be in keeping with the character and appearance of the remainder of the courtyard. 6.7 For the above reasons the application is considered to be acceptable and is recommended for approval.
7.1 The local authority, German Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
