This permission refers only to that required under the Control of Advertisements Regulations 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

1.1 The site is the footprint of an existing building which lies on the western side of Peveril Square, opposite the Sea Terminal. The building has a number of floors, some of which are occupied by Lloyds Bank and their associated services. This includes the ground floor and floors above. 1.2 The building is mainly finished in dark brown brick, is a relatively modern building with a slated mansard style roof which is set back from the top of the building proper with a small balcony area for each window within the mansard.
2.1 Proposed is the replacement of existing signage on the ground floor elevation above the entrance door and on the top floor just underneath the highest window on the front elevation. The existing signs are very similar to what is proposed: the high sign will still contain the black prancing horse but without the green background colour, and will have internal LED lighting all contained within a green border. It will project out by 60 mm and be 900 mm square in area. The ground floor sign will have the existing lettering changed from a 3D style lettering to a simple shallower lettering applied across the existing sign which is split into small squares, some of which contain the existing sign letters. The three legs symbol will be retained above the lettering. This sign will be 750 mm by 6 m and will project out by 60 mm .
3.1 The site lies within an area of Offices on the Douglas Local Plan of 1998. The site also lies within The Promenades Conservation Area, designated in 2002. The accompanying Character Appraisal describes the existing building as "regrettably...not of comparable quality with its predecessor". 3.2 As such, General Policy 6 requires that such signage is of a high standards of design and materials and relate well to the building and site on which they are to be displayed, are in keeping with the surrounding area and are located so as not to cause a highway hazard. 3.3 The site also lies within the Douglas Promenades Conservation Area. As such, the provisions of Planning Policy Statement 1/01 - Conservation of the historic Environment of the Isle of Man is relevant, and suggests that "Where matters such as Corporate Image are a consideration; for a conservation area the Department may require a deviation from what
might be acceptable in other high street locations and many large corporate bodies do have alternative designs of signage which might be suitable for use in conservation areas. In many cases it will be necessary for signage to adopt traditional design and materials, in keeping with the character of the building and neighbourhood as a whole. Externally illuminated signage with the appropriate detailing and colour rendered lamps, may be judged suitable." 3.4 Also, Environment Policies 35 and 37 are applicable:
EP35: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development".
EP 37: "As a general policy, advertisements within Conservation Areas will be permitted only is the proposal preserves or enhances the Conservation Area, the signage is in a style appropriate to the character of the area; traditional materials and finishes are used and glossy and highly reflective materials are excluded from proposals and internally illuminated box fascia and projecting box signs are exclude from the proposals." 3.5 The site also lies with a zone in which there is a 1 in 200 year flood risk. Whilst there are policies on this in the Strategic Plan, they are not considered relevant in the consideration of this application for replacement signage as the proposal will neither affect nor be affected by flooding.
4.1 Since the approval of the building in 1987 the building has had a number of changes of use and alterations, none of which is relevant to the consideration of this current application.
5.1 There are no representations on the file at the time of writing.
6.1 The proposed new advertisements are little different from the existing. As such there will be no significant impact from the proposed development sufficient to determine that the application is contrary to any of the relevant policies appertaining to it,
7.1 The local authority, Douglas Borough Council is, by virtue of the Town and Country Planning (Development Procedure) Order 2005 paragraph 6.4(d) interested parties and as such should be afforded party status to this application.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This approval relates to the erection of replacement signage as shown and described in the plans and information received on 12th July, 2013 and the development must be undertaken in accordance with these plans.
Any illumination must be a constant not an intermittent light source.
