This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

1.1 The application site is the curtilage of 8 Rowan Avenue, Ballawattleworth, Peel which is a two storey semi detached property situated to the southern side of the highway. To the rear of the application site is the rear garden of 8 Cushag Close which shares the rear boundary with the application site. There are two sheds adjacent to the rear boundary within the curtilage of the application site, one is approximately 6 \mathrm{~m} \times 3.6 \mathrm{~m} and 2.7 m in height. The smaller shed is approximately 2.1 \mathrm{~m} \times 1.5 \mathrm{~m}, both of the sheds are of timber construction. There is also fencing throughout the estate which denotes the boundaries, this is Lollipop style fencing.
2.1 The application seeks approval for the erection of a garden store to replace the existing sheds. The store would be constructed of block work and would have a green mineral felt roof, the walls would be rendered and painted, there would be double two sets of doors in the front elevation, at one end there would be a single pedestrian entrance and at the other would be a double pedestrian entrance. 2.2 The shed would be approximately 9.1 m in length and approximately 3.6 m in width, and would be approximately 2.7 m in height.
3.1 The following previous application is considered to be specifically material in the assessment of the current application:

4.1 The application site is within an area zoned as "Predominantly Residential" identified on the Peel Local Plan 1989. Given the nature of the application it is appropriate to consider General Policy 2 of the Isle of Man Strategic Plan (20th June 2007).
Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality.
5.1 Highways Division do not oppose as it has no traffic management, parking or road safety implications.
6.1 The application seeks approval for the erection of a garden store to replace the existing sheds. Having spoken with the applicant they advised that the proposed shed would be used for general domestic storage and workshop, such as storing camping equipment, garden furniture and would also provide a space for the applicant to work on his motorbike engines.. The main issues to consider in the assessment of the application are the impacts upon the character and appearance of the site and the impact upon the amenities of the local residents. 6.2 The proposed garden store would be approximately 9.1 m in length and would be approximately 0.6 m from the rear boundary fence. The proposed garden store would be of the same height as the existing but would be approximately 3.1 m longer than the existing shed. 6.3 The proposed garden store would be larger than a standard garden shed, and would be larger than what is allowed under the Permitted Development Order and therefore requires the submission of a planning application. The proposed garden store would be fairly large in terms of its length, but in terms of its overall increase over what is there at the moment it would be an additional 3.1 m in length. Given that the height of the proposed store would be the same height as the existing shed it is considered that the proposed store would not significantly increase the impact upon the neighbouring properties to the rear or to either side of the application site. 6.4 Given the height of the boundary fence it would mean that only the roof of the store would be visible, this is similar to the existing situation and it is therefore considered that the impact upon the neighbouring properties would be similar to the existing situation. 6.5 Given the orientation of the property, the height of the proposed structure and the boundary fencing it is considered that the proposed store would not result in undue loss of light; neither would it appear unduly overbearing. 6.6 The proposed garden store would not be overly visible from the main public thoroughfares; it is considered that the impact of the structure would be limited upon the character and appearance of the street scene. 6.7 For the above reasons the application is considered to be acceptable and is recommended for approval.
7.1 The local authority, Peel Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status. 7.2 The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
The development hereby permitted shall not be carried out except in full accordance with the following plans location plan, JH 01 and JH 02 received on 10th July 2013.
For the avoidance of doubt the proposed garden store may be used only for uses ancillary to the use of the dwellinghouse.
