(c) previously developed land which contains a significant amount of building; where the continued use is redundant; where redevelopment would reduce the impact of the current situation on the landscape or the wider environment; and where the development proposed would result in improvements to the landscape or wider environment; (d) the replacement of existing rural dwellings; (e) location-dependent development in connection with the working of minerals or the provision of necessary services; (f) building and engineering operations which are essential for the conduct of agriculture or forestry; (g) development recognised to be of overriding national need in land use planning terms and for which there is no reasonable and acceptable alternative; and (h) buildings or works required for interpretation of the countryside, its wildlife or heritage. 8. Environment Policy 2 states that "The present system of landscape classification of Areas of High Landscape or Coastal Value and Scenic Significance (AHLV's) as shown on the 1982 Development Plan and subsequent Local and Areas will be used as a basis for development control until such time as it is superseded by a landscape classification which will introduce different categories of landscape and policies and guidance for control therein. Within these areas the protection of the character of the landscape will be the most important consideration unless it can be shown that: (a) The development would not harm the character and quality of the landscape; or (b) The location for the development is essential. 9. Infrastructure Policy 3 states that "A balance must be struck between the need for new, evolving communications systems to satisfy residential and business demand and the impact that the necessary infrastructure will have upon the environment. Measures which may help to achieve a satisfactory balance will include a presumption against visually intrusive masts in sensitive landscapes, the encouragement of mast sharing by different operators, and the removal of redundant infrastructure. Exceptions to this policy would need to demonstrate a strategic national need, which cannot be otherwise secured by mast sharing or alternative locations."

Peel, we do note that the use of such a large 1.8 m diameter antenna dish will have a more direct impact on users of Peel Hill, who experience the development from a much closer distance. In the light of the latter point we would therefore question whether it makes complete sense to paint the antenna a colour designed to blend with the surrounding vegetation when it will be seen against the sky by users of the footpath immediately to the west.
We also note that the development is part of a wider scheme to improve the applicant's provision of a 3G service and is reliant on approval of a similar application at Jurby (PA No 13/00773 refers). It is our view that these developments, both singly and in combination, are broadly in keeping with Infrastructure Policy 3 of the Strategic Plan, in light of which we would not object to their approval."
can be controlled by attaching a condition to the planning approval. This would reduce significantly reduce the impact of the dish on the general locality.
In terms of the health issues of a telecommunication mast, the Isle of Man has no specific guidelines in how to deal with such concerns. However, the UK Government had advice in the form of Planning Policy Guidance Note 8 – Telecommunications (PPG8). PPG8 expressly advised that where a proposed telecommunications installation conforms to the recommendation of The Independent Expert Group on Mobile Phones (The Stewart Report) and the Guidelines for the public exposure set by The International Commission On Non-Ionising Radiation Protection (ICNIRP) then the local planning authority should have no concerns with regard to health and safety issues.
This has now been replaced by the National Planning Policy Framework which advices that "Local planning authorities must determine applications on planning grounds. They should not seek to prevent competition between different operators, question the need for the telecommunications system, or determine health safeguards if the proposal meets International Commission guidelines for public exposure."
The application is accompanied by a certificate of compliance with the World Health Organisation ICNIRP guidelines for public exposure.
The Health and Safety Inspectorate is responsible for the monitoring of telecommunications installations to ensure compliance with the ICNIRP Guidelines.
The Highways Authority and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Manx National Heritage have commented on planning matters and as such should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the erection of a 1.8 m communications dish as shown in drawing numbers 062 / 110 issue B, 062 / 112 issue B, 062 / 113 issue B, 062 / 114 issue B date stamped 1st July 2013.
C 3. No development shall take place until details of the colour coating of the dish has been submitted to and approved in writing by the Planning Authority; and thereafter the development shall be carried out in accordance with the approved details.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager/ Senior Planning Officer.
