In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Philamere Limited, Ref 13/00737/B, for the Installation of additional roller doors and pedestrian entrance at Unit 26 Colas Drive Balthane Ballasalla Isle Of Man IM9 2AH subject to compliance with the following condition(s):
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
The development hereby permitted shall not be carried out except in full accordance with the following plans 01 and 02 received on 24th June 2013.

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them.
This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

1.1 The site represents the curtilage of an existing plot situated on the corner of the main road through Balthane Industrial Estate and a minor road leading to the north east. The site accommodates an industrial building with parking and manoeuvring space to the south west and northwest.
2.1 The application seeks approval for the installation of additional roller doors and pedestrian entrance to the south west elevation.
3.1 The site lies within an area of Industrial Use on the Area Plan for the South. 3.2 Due to the site location, zoning and the type of proposal, the following policies are relevant for consideration:- 3.3 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services;
(k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption."
4.1 Whilst there have been a number of applications submitted in respect of this site, none are considered relevant in the determination of this application.
5.1 Malew Parish Commissioners and the Highway Division have no objection.
6.1 The main issue to consider is whether the proposals would have significant visual impacts upon the appearance of the individual building and the street scene. The existing building is an industrial building which has little architectural qualities. The installation of the proposed door will neither improve or worsen the appearance of the existing building or have an impact upon the visual amenities of the area.
7.1 Overall, it is considered the proposal would comply with General Policy 2 of the Isle of Man Strategic Plan and recommended for an approval.
8.1 It is considered that the following meet the criteria of Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d) and should be afforded interested party status:
Malew Parish Commissioners 8.2 The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
