In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Mr Paul \& Mrs Gillian Whittley, Ref 13/00735/B, for the Installation of replacement conservatory roof at Clitheroe House Main Road Santon Isle Of Man IM4 1EE subject to compliance with the following condition(s):

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

1.1 The application site is the curtilage of Clitheroe House, Main Road, Santon which is a detached two storey property situated to the south eastern side of Castletown Road.
2.1 The application seeks approval for the installation of replacement conservatory roof. The proposal involves the removal of the existing polycarbonate roof with a fully insulated Decra lightweight roof system, colour to match the existing dwelling.
3.1 There are a number of previous planning applications, however none is considered specifically material in the assessment of the application.
4.1 The site is designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Existing Predominantly Residential.
4.2 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
a) Is in accordance with the design brief in the Area Plan where there is such a brief; b) Respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) Does not affect adversely the character of the surrounding landscape or townscape; d) Does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; e) Does not affect adversely public views of the sea; f) Incorporates where possible existing topography and landscape features, particularly trees and sod banks; g) Does not affect adversely the amenity of local residents or the character of the locality; h) Provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; i) Does not have an unacceptable effect on road safety or traffic flows on the local highways;
j) Can be provided with all necessary services; k) Does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; I) Is not on contaminated land or subject to unreasonable risk of erosion or flooding; m) Takes account of community and personal safety and security in the design of buildings and the spaces around them; n) Is designed having due regard to best practice in reducing energy consumption."
5.1 There are no views on the file at the time of writing.
6.1 Visiting the site and considering the submission it is considered the two main issues with the proposal is the potential impact upon the visual amenities of the street scene and the potential impacts upon neighbouring amenities, namely loss of light and/or overbearing impacts upon outlook. 6.2 In terms of the street scene the proposal is set to the rear elevations and therefore the proposed works would not be apparent from the Castletown Road. However, the proposal would be apparent form a lane which runs to the northeast of the site. However, the works would be in keeping with the existing property 6.3 In relation to the impact upon neighbouring amenities, the proposed works will make the existing conservatory more apparent and will appear to increase the mass, given the light weight appearance of the existing polycarbonate roof being replaced with a solid roof structure. However, given the distance from neighbouring properties the modest height and size of the proposed roofing it is considered the proposal would have little in the way of any impact upon neighbouring amenities.
7.1 Overall, it is considered the proposal would comply with the Isle Of Man Strategic Plan therefore it is recommended that the application be approved.
8.1 The local authority, Santon Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
