THIS APPLICATION IS REFERRED TO THE PLANNING COMMITTEE AT THE REQUEST OF A PLANNING COMMITTEE MEMBER
1.1 The application site is the curtilage of Villiers Building, a five storey building sited on the south western side of Douglas Promenade on the Junction to Victoria Street within the Douglas Promenades Conservation Area. The building is on a corner plot with Victoria Street running parallel of the site to the south. The building is currently used as offices and is of a modern form. 1.2 The surrounding area is characterised by predominantly office units, public houses and retail units that have retained many of their original Victorian features and from. Jubilee Building sits adjacent to application site with the Jubilee Clock located 18.5 metres east of the application site.
2.1 This partial retrospective planning application seeks approval for the installation of self adhesive vinyl signage to the ground floor windows fronting Victoria Street and Loch Promenade. 2.2 The proposed signage would be permanent and would display company names, logos and information.
3.1 The supplication site has been the subject of twenty previous planning applications, two of which that were granted planning approval are considered materially relevant to the assessment of this current planning application given the level and nature of proposed development:
PA 06/00325/D: Erection of illuminated advertising signage. This previous planning application was permitted.
PA 96/01235/D: Provision of advertisement signs. This previous planning application was permitted.
3.1 In terms of local plan policy, the application site is classed as Predominantly Offices under the Douglas Local Plan Order 1998 Map No. 1 (Central Area). As previously mentioned the application site is within the Douglas Promenades Conservation Area. 3.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains four policies that are considered specifically relevant to the assessment of this current planning application:
General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not affect adversely the amenity of local residents or the character of the locality;
General Policy 6 states: "Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they: (a) are of a high standard of design and materials and relate well to the building and site on which they are to be displayed; (b) are in keeping with and do not detract from the surrounding area; and (c) are located so as not to cause a highway safety hazard."
General Policy 7 states: "Within our towns and villages, the display of external advertisements on sites or buildings other than those to which they relate will not generally be permitted."
Environment Policy 35 states "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character of appearance of the area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
4.1 Douglas Borough Council has no objection to the current planning application. 4.2 The Department of Infrastructure Highways Division have no objection to the current planning application.
5.1 The main issues to consider in the assessment of this planning application are the impacts of the installation of ground floor vinyl signage on the appearance of the existing building and street scene.
5.2 The proposed signage and existing signage is considered to be acceptable. Whilst they will be more prominent features within the street scene due to the design and scale, compared to the existing appearance, it is deemed the existing and proposed signage would improve the overall appearance of the building would will fit in well and would not cause any adverse visual impacts to the detriment of the street scene and Conservation Area. 5.3 It is considered that both the existing and proposed signage is suitably high standard and relates well to an existing modern innovative building. The existing and proposed signage is also not judged to cause a highway safety hazard.
6.1 Overall, it is concluded that the planning application is in accordance with General Policy 2, 6 and 7 and Environment Policy 35 of the Isle of Man Strategic Plan 2007. 6.2 It is recommended that the planning application be permitted.
8.1 The local authority, Douglas Borough Council, is by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(d), considered "interested persons" and as such should be afforded party status. 8.2 The Highways Division is part of the Department of Infrastructure of which the planning authority is also part. As such, the Highways Division should not be afforded separate party status.
Recommended Decision: Permitted
