ON APPEAL

Application No: 11/00090/B Proposal: Erection of bollards and chains to parking area (retrospective), 32 Malew Street, Castletown Applicant: Castletown Securities Limited Appellant: Castletown Securities Limited I refer to the recent appeal in respect of the above planning application. In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.

The Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the refusal of the application under Article 6 of the Town & Country Planning (Development Procedure) Order 2005 should be confirmed. A copy of the original notice is enclosed for your reference.

Additionally, the Minister has noted that the development has already been carried out. In these circumstances, he has directed that the file should be referred to the Senior Planning Officer for consideration of appropriate enforcement action.

REASON(S) FOR REFUSAL:

The panels, chains and posts are utilitarian in appearance and out of character with the building in front of which they have been erected and the Conservation Area in which they are sited. They do not preserve or enhance the character or appearance of the Conservation Area and as such contravene Environment Policy 35 of the Strategic Plan and Planning Policy Statement 1/01 - Conservation of the Historic Environment of the Isle of Man Policy CA/2.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

Any appeal has been determined;

Whichever is the later. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
