In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Department Of Education And Children, Ref 13/00569/B, for the installation of replacement boundary fencing and gates, erection of playground fence / gates and construction of new concrete steps (amended plans received which show minor extension to red line to the north; alteration to height of fence next to no 10 Darragh; and supporting letter from school) at Anagh Coar School Darragh Passage Douglas Isle Of Man IM2 2BX subject to compliance with the following condition(s):
NOTE The Isle of Man Water & Sewerage Authority advises that there are public sewers within the footpath adjacent the proposed fencing. The applicant is advised to discuss measures to protect the sewer during construction with the the Isle of Man Water & Sewerage Authority before proceeding with any works.
NOTE The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may need to be diverted before any work can be carried out on site.
The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

06/00107/B - approval granted in 2007 for improvements to existing playground to include new retaining wall and fencing.
There are a number of other approvals for works of a minor nature which are not considered relevant to the current application.
The Douglas Local Plan 1998 identifies the site as being a primary school.
General Policy 2 of the Isle of Man Strategic Plan 2007 is relevant: 'Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (I) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption.'
Community Policy 5 of the Isle of Man Strategic Plan 2007 is relevant:
Permission will generally be given for proposals to improve or extend existing schools and institutions of higher education and to build new schools, subject to their being sited and designed in accordance with the other policies of this plan, having particular regard to the potential for community use of the buildings and the associated Open Space.
Justification for the scheme
The effect of the proposal on the character and appearance of the area 18. The proposed fencing is in the most part of similar height to the existing. However, there is a noticeable increase in height for the majority of the south east boundary (1.5-1.7 metres to 3 metres), in front of No. 10 Darragh ( 1.8 metres to 2.5 metres) and the east corner of the site ( 1.7 metres to 3.0 metres). The elevation drawings of the new fencing looks quite austere, however, photographs of the same fencing used elsewhere have been seen and these show the fencing to be more subtle and visually appealing. The fencing would be finished in green which would give the fencing a less harsh and more inviting appearance. The proposed steps in the north west corner of the site would have a very limited visual impact. They should not interfere with the existing trees in this corner.
The effect of the proposal on neighbour amenity 19. The planning officer initially had concerns about the impact of the new fencing on the outlook of Nos. 15 to 20 Cullyn, a small block of flats to the immediate south. However, having further considered the issue, it is felt that there is sufficient separation between the fencing and the front of the properties such as not to result in an unacceptable loss of outlook or amenity to these properties. There has also been concern about the effect of the new fencing on the outlook of the front of No. 10 Darragh. At this point, the height of the fencing will be increased from 1.8 metres to 2.5 metres, which won't create a particularly attractive environment for No. 10. The planning officer has raised this issue with the agent, but the school say that 2.5 metres is the minimum height necessary to provide security. The Planning Authority has written to the occupier of No. 10 Darragh asking for their views but no comments have been received. Douglas Borough Council have also been asked to provide specific comments on this point, given the possibility that this might be local authority housing, however, again no comments have been received. Part of this area of fencing has already been reduced from 3 metres to 2.5 metres following concerns expressed by the planning officer. On balance, and taking into account that no objections have been received, it is considered the effect of the proposal on No. 10 Darragh is acceptable. 20. Elsewhere, it is considered that the increase in the height of the fencing would not have a harmful effect on the amenities of nearby residents. The other main area where the fencing would be increased in height is in the east corner of the school grounds; however, this is next to the shop and won't adversely affect the amenities of the area. The repositioning of the pedestrian gate to the north west corner should not give rise to any significant additional amenity issues.
Other issues 21. The WSA has asked the applicant to discuss measures to protect the public sewer with it before commencing with works. This is considered to be a civil issue and not a planner matter, but can be conveyed to the applicant by way of an informative. Similarly, the comments of the MEA are advisory only and an advice note is also recommended.

The development hereby permitted shall not be carried out except in full accordance with the following plans: Drawing Numbers 17560203 (existing fencing) received on 09 May 2013; 17560201 (site location plan) and 17560205 (new steps and fencing to the side) received on 03 July 2013; 175602 02A (proposed block plan) and 175602 04A (proposed fence elevations) received on 11 October 2013.
