The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This approval relates to drawing no.s P01 rev. A, P02 rev. C, P03 rev. B, P04 rev. B and P05 rev. B date stamped the 9th May 2013.

1.1 The application site is the residential curtilage of a detached dwelling that is located on King Edward Park in Onchan.
2.1 The proposal comprises the erection of a replacement dwelling (comprising amendments to previously approved PA 11/00528/B).
3.1 The application site has been the subject of a number of previous planning applications, two of which are considered specifically material to the assessment of this current planning application: 3.2 Planning application 10/01711/B sought planning approval for the erection of a replacement dwelling on the application site. This previous planning application was refused on the 8th March 2011. 3.3 Planning application 11/00528/B sought planning approval for the erection of a replacement dwelling on the application site. this previous planning application was approved on the 22nd June 2011.
4.1 In terms of local plan policy, the application site is within an area recognised as being within predominantly residential use under the Onchan Local Plan. Policy O/RES/P/21 of the written statement (Planning Circular 1/2000) that accompanies the Onchan Local Plan states: "Extensions and alterations to existing residential property will generally not be opposed where such proposals are appropriate in terms of scale, massing, design, appearance and impact on adjacent property." 4.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application. General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption."
5.1 Onchan District Commissioners recommend that the planning application be approved. 5.2 The Department of Infrastructure Highways Division do not oppose the planning application. 5.3 The Isle of Man Water and Sewerage Authority have no objections to the planning application.
6.1 The planning application seeks planning approval for the erection of a replacement dwelling on the application site. The proposed development is very similar to that of approved, and currently extant, under previous planning application 11/00528/B. The key differences between that previous planning approval and the current planning application are i) alterations to the style and arrangements of windows; ii) a change to the style of balustrade; iii) the installation of two flues; and iv) the installation of an oil tank. Whilst the planning application details the introduction of timber fencing within the garden and alterations to internal layout the fencing appears to be within permitted development limits and the internal alterations do not constitute development in themselves. 6.2 The changes from the previously approved development to the development now proposed do not significantly alter the overall appearance, impact and acceptability of the proposal. As with previous planning application 11/00528/B it is considered that the impact of the proposed development on public amenity, private amenity, highway safety or any other obvious material planning consideration is acceptable. The proposal is concluded to satisfactorily accord with the provisions of Policy O/RES/P/21 of Planning Circular 1/2000 and General Policy 2 of the Isle of Man Strategic Plan 2007.
7.1 It is recommended that the planning application be approved.
8.1 It is considered that the following parties that made representations to the planning application should be afforded interested party status:
Onchan District Commissioners; and The Isle of Man Water and Sewerage Authority. 8.2 It is considered that the following parties that made representations to the planning application should not be afforded interested party status:
The Department of Infrastructure Highways Division.
