In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Jane Susan Knowles, Ref 13/00518/B, for the installation of satellite dish (retrospective) at 7 Malvern Road Douglas Isle Of Man IM2 5AS subject to compliance with the following condition(s):
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
The development hereby permitted shall not be carried out except in full accordance with the site plan and "in-situ" photograph, received on 29 April 2013.

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them.
This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

1.1 The application site is the curtilage of 7 Malvern Road, Douglas; number 7 is a two storey, mid-terraced property. It is situated to the south west of the highway. 7 Malvern Road is within the Selborne Drive Conservation Area. 1.2 The terrace along the south west of Malvern Road is characterised by the strong, crenellated facades with double-storey bay windows. These unusual features are complemented by the unusual brickwork of the properties, which consist of primarily yellow brick with red brick decoration.
2.1 Retrospective approval is sought for the installation of a satellite dish. As the planning application is retrospective, the language used in this report reflects the fact that the works have already taken place. 2.2 The satellite dish is black and attached to the dwelling's chimney by a bracket. No dimensions have been provided, although it was evident from the site visit that the dish was of "standard" satellite dish size. The applicants have confirmed this verbally. Its location on the front elevation of the dwelling makes it visible from Malvern Road, but not from the unnamed rear path running parallel to Malvern Road.
3.1 The application site has not been the subject of any previous planning applications that are considered specifically material to the assessment of this current planning application.
4.1 In terms of local plan policy, the application site is designated as Predominantly Residential under the Douglas Local Plan Order 1998 Map No. 2 (South). 4.2 Malvern Road is within the Selborne Drive Conservation Area. 4.3 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains two policies that are considered specifically material to the assessment of this current planning
application. The parts of General Policy 2 relevant to this application state: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality'. 4.4 As Malvern Road is within the Selborne Drive Conservation Area, Environment Policy 35 also applies. It states that: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development".
5.1 No representations have been received to this planning application.
6.1 Given the nature of the planning application, it is important to consider the impact the addition of a satellite dish would have on the appearance of the dwelling itself in the context of the Selborne Drive Conservation Area. It is noted that satellite dishes do not require planning permission when proposed outside of Conservation Areas and, as such, the impact on the Selborne Drive Conservation Area is, in the case of this planning application, the most important material consideration. 6.2 The dish will be visible but not prominent and it is not considered that the dish will provide a discordant feature which would be detrimental to the amenities or character of the Conservation Area of which the application site forms part. Moreover, at least four other satellite dishes are already present on dwellings both (a) on Malvern Road and (b) across the Conservation Area. Television aerials are also clearly visible but not prominent. 6.4 The Character Appraisal for the Selborne Road Conservation area concludes with the following sentence: "Conservation Area designation aims to maintain and improve the unique qualities of a particular area, whilst also allowing it to prosper and consolidate". It is considered that a refusal would be contrary to the intention to allow the area to prosper and consolidate. Moreover, given the other satellite dishes and similar ephemera already not unsuccessfully integrated within the Conservation Area, it is considered that the current proposal does not conflict with this aim. 6.5 On the basis of the above, the application is not considered to be in conflict with either Strategic Plan or Conservation Area policy.
7.1 It is recommended that the planning application be permitted.
8.1 The local authority, Douglas Borough Council, is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
