Isle of Man Government £n<rj| Vunntn Hartford Homes Unit 2 Middle River Douglas IM2 lAL Town and Country Planning Act 1999 The Town and Country Planning (Development Procedure) (No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Hartford Homes, Ref 14/00390/B, for the demolition of existing commercial buildings and erection of two town houses (amendments to PA 09/01624/B) at 2 - 4 Derby Square Douglas Isle Of Man IMl 3LS subject to compliance with the following condition(s); The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. 1. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. The roof shall be finished with natural slate as confirmed by the applicant's letter of 16 May 2014, and shall be permanently retained as such. Reason: In the interests of the character and appearance of the Conservation Area. 2. 3. The windows on the west, north and south elevations shall be of a vertically sliding sash design as confirmed by the applicant's letter of 16 May 2014. Reason: In the interests of the character and appearance of the Conservation Area. TTie garage shall at all times be made available for the parking of private motor car(s) and shall be retained available for such use. 4. Reason: To provide adequate off-street parking. 5. The proposed windows on the south gable shall be glazed with obscure glass to Pilkington Level 5 or equivalent. The window shall also be non-opening. The window(s) shall be permanently retained as such. Reason: To safeguard the amenities of adjoining occupiers from overlooking and loss of privacy.

This approval relates to Drawing Numbers 06 (site location plans), 07 (floor plans) 08, 09 (elevations) and information on windows (Rehau Heritage range) received on 28 March 2014; and Drawing Number 10 (detailed elevation) received on 16 May 2014. Director of Planning and Building Control Guidance Note This decision was made by the Director of Planning and Buiiding Controi in accordance with the authority delegated to him. This permission refers oniy to that required under the Town and Country Planning (Development Procedure) (No 2) Order 2013. Any appeal against this decision must be in accordance with Article 8 of the Order. A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: • Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150); • The reasons for making the appeal; and • An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. The proposed development must not be commenced until either; • The time for requesting an appeal has expired; or • Any appeal has been determined; Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House. Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
