The original application 13/91487/B to replace and lift the existing garage roof to create first-floor living accommodation was refused by the planning authority for being contrary to General Policy 2(b) and 2(c) of the Isle of Man Strategic Plan due to its adverse impact on the character and appearance of the dwelling and area. The appellants argued that the refusal reasons were subjective, cited similar approved extensions nearby as precedents, noted the modern nature of the house, and claimed inadequate justification against policy. The planning authority defended the refusal on design grounds, emphasising the 'hunched' and unattractive roof appearance disrupting the uniformity of the street scene. The inspector, following an inquiry and site visit, agreed with the authority, finding the reduced rear roof pitch of 12.5° created an alien and eccentric feature prominently visible due to the site's gap to the neighbour, distinguishing it from cited precedents. The appeal was dismissed, upholding the refusal.
