I refer to the recent appeal in respect of the above planning application.
In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.
The Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the Planning Committee's Approval of the application should be confirmed. Formal notice of this decision is attached.

In pursuance of his powers under the above Act and Order, the Minister for Infrastructure does hereby APPROVE planning application 13/00409/B by Mr Vincent Garvey for Erection of a detached dwelling, land adjacent to Longmead, Ballakillowey Road, Colby, IM9 4BF, subject to the following conditions:
The development hereby permitted shall commence before the expiration of four years from the date of this approval.
The development permitted shall not be carried out except in full accordance with Drawing No's 01 Rev P1, 02 Rev P1, 03 Rev P1 and 04 Rev P1, all date-stamped 3 April 2013; and sections received on 25 April 2013.
Within two months of the completion or first use of the approved access, whichever is the soonest, the access at the northern end of the site shall be closed off using hedging to match the existing boundary treatment.
The access and its visibility splays shown on Drawing No. 01 Rev P1 shall be provided prior to the commencement of works.
The visibility splays shown on Drawing No. 01 Rev P1 shall be permanently retained.
The windows in the two en-suite bathrooms in the rear dormers of the dwelling hereby approved shall be obscure-glazed to Level 5 (as detailed on Pilkington's textured glass range) or its equivalent.
Before development commences, details of boundary treatments shall be submitted to and approved in writing by the Planning Authority. The boundary treatments shall be provided and retained in accordance with the approved details.
