ON APPEAL Application No: 11/00038/D Proposal: Erection of advertising banners (retrospective), Empress Hotel, Central Promenade, Douglas Applicant: The Empress Hotel Limited Appellant: The Empress Hotel Limited
I refer to the recent appeal in respect of the above application under the Control of Advertisements Regulations 2005.
In accordance with the provisions of the Regulations, I am enclosing herewith a copy of the report of the person appointed to consider the appeal.
The Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the refusal of the application under Regulation 9 should be confirmed. A copy of the original notice is enclosed for your reference.
Additionally, the Minister has noted that the banner is already being displayed. In these circumstances, he has directed that the file should be referred to the senior Planning Officer for consideration of appropriate enforcement action.
